It is enacted by the General Assembly as follows: | |
|

     SECTION 1. Chapter 39-1 of the General Laws entitled "Public Utilities Commission" is |
|

hereby amended by adding thereto the following sections: |
|

     39-1-15.1. Enforcement powers of inspectors. – Examiners, field investigators, hearing |
|
1-4 |
officers, regulatory inspectors, and other employees of the division designated by the |
|
1-5 |
administrator with respect to the enforcement of the provisions of chapters 12 through 14.1 |
|
1-6 |
inclusive of this title, shall have and exercise, throughout this state, all powers of police officers |
|
1-7 |
including the power to arrest, without warrant, any person who violates any provision of said |
|
1-8 |
chapters, and the agents may serve all process lawfully issued by the administrator. Whenever a |
|
1-9 |
complaint is made of any violation of the provisions of chapters 12 through 14.1 inclusive of this |
|
1-10 |
title, by any examiner, field investigator, hearing officer, regulatory inspector, or any other |
|
1-11 |
employee of the division, he or she shall not be required to furnish surety for costs or be liable for |
|
1-12 |
costs upon any complaint. |

1-13 |
     39-1-15.2. Enforcement by police departments. – The administrator is hereby |
|
1-14 |
authorized to avail himself or herself of such state, city, and town police departments as are or |
|
1-15 |
may hereafter be existing by law, to enforce the provisions of chapters 12 through 14.1 inclusive |
|
1-16 |
of this title and the rules, regulations, and orders of the administrator made under said chapters; |
|
1-17 |
and the police departments are hereby given the necessary authority and power, in addition to |
|
1-18 |
those which they now possess, to carry into effect the directions of this section. |

2-19 |
     SECTION 2. This act shall take effect upon passage. |

     This act would clarify the powers of the division of public utilities and carrier’s personnel |
|

relative to enforcement of all provisions of the motor carrier pursuant to chapter 39-1 and would |
|

authorize state and municipal police departments to assist the division in those regulatory |
|
3-4 |
endeavors. |

     This act would take effect upon passage. |
