It is enacted by the General Assembly as follows: | |

     SECTION 1. Chapter 21-31 of the General Laws entitled "Rhode Island Food, Drugs, |
|
1-2 |
and Cosmetics Act" is hereby amended by adding thereto the following section: |
|

     21-31-24. Drug disposal. -- (a) Notwithstanding any provisions of the general or public |
|
1-4 |
laws to the contrary, any city or town may authorize the use of its police department to display a |
|
1-5 |
container suitable for use as a receptacle for used, expired, or unwanted drugs or drug products. |
|
1-6 |
The receptacle shall only permit the deposit of items, and the contents shall be locked and |
|
1-7 |
secured. The container shall be accessible to the public and shall have posted clearly legible |
|
1-8 |
signage indicating that expired or unwanted drugs or drug products may be disposed of in the |
|
1-9 |
receptacle. |
|
1-10 |
     (b) The used, expired, or unwanted drugs or drug products disposed of under this section |
|
1-11 |
shall not include any controlled substance, as defined in section 21-28-2.08, except as permitted |
|
1-12 |
under federal law. |
|
1-13 |
     SECTION 2. This act shall take effect upon passage. |
