RELATING TO EDUCATION -- CHILDREN WITH DISABILITIES

     Introduced By: Senators Pichardo, Crowley, Goodwin, and Jabour

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 16-24 of the General Laws entitled "Children with Disabilities" is

hereby amended by adding thereto the following section:

     16-24-19. Referral to an individualized education program team. – Provision shall be

1-4

made for the prompt referral to an individualized education program team, pursuant to 34 CFR

1-5

300.23 et seq., of all children who have been suspended repeatedly or whose behavior, attendance

1-6

or progress in school is considered unsatisfactory or at a marginal level of acceptance.

     SECTION 2. This act shall take effect upon passage.

     This act would require that there be a referral to an IEP team for all children who have

been suspended repeatedly or whose behavior, attendance or progress in school is unsatisfactory.
