It is enacted by the General Assembly as follows: | |

     SECTION 1. Title 23 of the General Laws entitled "HEALTH AND SAFETY" is hereby |
|

amended by adding thereto the following chapter: |

     CHAPTER 24.11 |
|

COMPREHENSIVE CHILDREN'S JEWELRY SAFETY ACT |
|
1-5 |
     23-24.11-1. Short title. – This act shall be known and may be cited as the |
|
1-6 |
“Comprehensive Children’s Jewelry Safety Act.” |
|
1-7 |
     23-24.11-2. Definitions. – (a) “Children’s jewelry” means jewelry designed or intended |
|
1-8 |
primarily for use by children twelve (12) years of age or younger to be worn as an item of |
|
1-9 |
personal ornamentation, and does not include: |
|
1-10 |
     (1) Toys or other products intended for use when a child plays; |
|
1-11 |
     (2) Accessories; |
|
1-12 |
     (3) Apparel; |
|
1-13 |
     (4) Footwear; or |
|
1-14 |
     (5) Any other product whose purpose is primarily functional and not ornamental. |
|
1-15 |
     (b) “ASTM F 2923-11” means the ASTM (American Society for Testing and Materials) |
|
1-16 |
International Standard Specification for Consumer Product Safety for Children’s Jewelry in effect |
|
1-17 |
on January 1, 2012. |
|
1-18 |
     23-24.11-3. Requirements. – All children’s jewelry manufactured one hundred eighty |
|
1-19 |
(180) days after the effective date of this act shall meet the requirements of ASTM F 2923-11. |
|
2-1 |
     23-24.11-4. Duration. – The provisions of this chapter shall remain in effect until a |
|
2-2 |
superseding federal standard for children’s jewelry takes effect. |
|
2-3 |
     SECTION 2. This act shall take effect upon passage. |
