It is enacted by the General Assembly as follows: | |

     SECTION 1. Chapter 28-29 of the General Laws entitled "Workers' Compensation - |
|

General Provisions" is hereby amended by adding thereto the following section: |
|

     28-29-31. Bidders' required statement. – (a) All contractors and subcontractors shall |
|
1-4 |
agree as pre-condition for bidding on public works contracts for any prevailing wage work for |
|
1-5 |
state or municipal public works contracts to comply with the prevailing conditions: |
|
1-6 |
     (1) Prior to any work being performed by an individual contractor on any state, or |
|
1-7 |
municipal public works project, contractors and subcontractors must provide certification that |
|
1-8 |
their workers are covered by current workers' compensation coverage. Said certification shall be |
|
1-9 |
submitted on a form to be provided by the department of labor and training. The exception set |
|
1-10 |
forth in subdivision 28-29-2(4) shall not apply to public construction work as designated herein. |

1-11 |
     (2) Nothing in this section shall be construed to limit the provisions of chapter 37-14.1. |
|
1-12 |
     SECTION 2. This act shall take effect upon passage. |
