RELATING TO ANIMALS AND ANIMAL HUSBANDRY -- SALE OR ADOPTION OF | |

SPAYED OR NEUTERED CATS | |

It is enacted by the General Assembly as follows: | |
|

     SECTION 1. Section 4-24-5 of the General Laws in Chapter 4-24 entitled "Permit |
|

Program for Cats" is hereby amended to read as follows: |
|

     4-24-5. Sale or adoption of cats. -- (a) Any person or licensed business who provides or |
|
1-4 |
offers to the public, whether or not for compensation, any pet or pet related goods, where they are |
|
1-5 |
the primary products, or pet services shall provide to their clients, at no charge, information |
|
1-6 |
relating to pet care and ownership, including information on city and town laws pertaining to |
|
1-7 |
animal control. |
|
1-8 |
      (b) Any person offering cats for sale or adoption shall disclose to any purchaser or |
|
1-9 |
adoptive owner, information regarding the licensing or permit requirements of the city or town in |
|
1-10 |
which they reside applicable to the animal. |
|
1-11 |
     (c) No licensed releasing agency, as defined in subdivision 4-19-2(16), shall sell, |
|
1-12 |
otherwise convey, or offer for adoption any cat which has not been spayed or neutered, unless the |
|
1-13 |
animal is being specifically offered for breeding purposes. Alternatively, the prospective owner |
|
1-14 |
shall be allowed to present proof that the cat's spay/neuter procedure fee has been prepaid. A fine |
|
1-15 |
of three hundred dollars ($300) shall be imposed on any licensed releasing agency, as defined in |
|
1-16 |
subdivision 4-19-2(16), violating this section with all the fines to be forwarded to the state |
|
1-17 |
department of environmental management and not the general fund. |
|
2-18 |
     SECTION 2. This act shall take effect upon passage. |
