RELATING TO HUMAN SERVICES - BEHAVIORAL HEALTHCARE, DEVELOPMENTAL

DISABILITIES AND HOSPITALS - MENTAL HEALTH LAW

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 40.1-5 of the General Laws entitled "Mental Health Law" is

hereby amended by adding thereto the following section:

     40.1-5-8.1. Jurisdiction of the district court. – The district court shall exercise

jurisdiction in both law and equity over any petition brought pursuant to this chapter, or for the

1-5

purpose of effectuating the intent of this chapter, including, but not limited to, petitions for

1-6

instructions for care and treatment of patients, providing substituted consent, and continued

1-7

oversight of orders.

     SECTION 2. This act shall take effect upon passage.
