RELATING TO HUMAN SERVICES - MEDICAL ASSISTANCE

     Introduced By: Representatives Morgan, Newberry, Ehrhardt, Reilly, and Chippendale

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 40-8 of the General Laws entitled "Medical Assistance" is hereby

amended by adding thereto the following section:

     40-8-31. Death of recipient of Medicaid benefits. -- Upon the death of any person

1-4

receiving Medicaid benefits the Medicaid service provider shall notify the department of human

1-5

services of the death of the recipient of said services within five (5) days of receiving information

1-6

that the Medicaid recipient is deceased.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would mandate that upon the death of a person receiving Medicaid benefits the

service provider would notify the department of human services of the recipient’s death within

2-3

five (5) days of receiving that information.

     This act would take effect upon passage.
