A N A C T

RELATING TO TOWNS AND CITIES -- LOCALLY ADMINISTERED PENSION FUNDS--

MUNICIPAL RETIREMENT

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 45-65 of the General Laws entitled "Retirement Security Act for

Locally Administered Pension Funds" is hereby amended by adding thereto the following section:

     45-65-10. Binding arbitration prohibited. – No binding arbitration shall be employed

in the development of any said pension plan. In developing a plan pursuant to this chapter, no

provision or provisions in any collective bargaining agreement providing for binding arbitration

1-6

shall be applicable or applied to the process. The development of a funding plan shall be deemed

1-7

to take precedence over any provisions providing for binding arbitration between the municipality

1-8

and any class or set of the municipality’s active, inactive, and retired employees.

     SECTION 2. This act shall take effect upon passage.
