RELATING TO EDUCATION - SCHOOL FOR THE DEAF | |

It is enacted by the General Assembly as follows: | |
|

     SECTION 1. Section 16-26-7 of the General Laws in Chapter 16-26 entitled "School for |
|
1-2 |
the Deaf" is hereby amended to read as follows: |
|
1-3 |
     16-26-7. Persons admissible. -- (a) All children of parents, or under the control of |
|
1-4 |
guardians or other persons, legal residents of this state, between the ages from birth to twenty-one |
|
1-5 |
(21) years, whose hearing or speech, or both, are impaired as to make it impracticable for this |
|
1-6 |
student to make progress toward his or her educational goals by attending the public schools may |
|
1-7 |
attend the Rhode Island School for the Deaf, without charge, under any rules and regulations as |
|
1-8 |
the board of regents for elementary and secondary education may establish. |
|
1-9 |
      (b) Deaf persons from birth to twenty-one (21) years, who are legal residents of the state, |
|
1-10 |
shall be entitled to the privilege of the school without charge, and for any period of time in each |
|
1-11 |
individual case as may be deemed appropriate by the board of regents for elementary and |
|
1-12 |
secondary education; residents of other states may be admitted upon the payment of any rates of |
|
1-13 |
board and tuition as may be fixed by the board. |
|
1-14 |
     (c) A school district of this state shall not be responsible for the cost of a student |
|
1-15 |
attending the Rhode Island school for the deaf, unless the individualized educational plan (IEP) |
|
1-16 |
team of that school district is responsible for the placement of that student at the Rhode Island |
|
1-17 |
school for the deaf. |
|
2-18 |
     (d) This chapter shall be administered in accordance with the provisions of 20USC |
|
2-19 |
1400,34CFR, port 300.1 – 300D.818. |
|
2-20 |
     SECTION 2. This act shall take effect upon passage. |

     This act would provide that a school district of this state would not be responsible for the |
