A N A C T

RELATING TO TOWNS AND CITIES -- STATE AID

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 45-13 of the General Laws entitled "State Aid" is hereby amended

by adding thereto the following section:

     45-13-5.3. Municipal services pro rata reimbursement. – Notwithstanding any general

or public law to the contrary, any municipality shall be authorized to charge institutions included

1-5

in subsection 45-13-5.1(b) for essential services on a pro rata basis according to the assessed

1-6

value of the property serviced. The municipality in which the property lies is authorized to charge

1-7

a sum equal to not more than twenty-five percent (25%) of all taxes that would have been

1-8

collected had the property been taxable. For the purposes of this section, “essential services”

1-9

includes, but is not limited to, police, fire and rescue.

     SECTION 2. This act shall take effect upon passage.

     This act would permit municipalities to seek reimbursement for essential services

provided to certain tax exempt properties based on pro rata basis according to the assessed value

of the property serviced.

     This act would take effect upon passage.
