RELATING TO ALCOHOLIC BEVERAGES - ALCOHOL ENERGY DRINKS | |

It is enacted by the General Assembly as follows: | |
|
1-1 |
     SECTION 1. Chapter 3-9 of the General Laws entitled "Adulterated Liquors" is hereby |
|

amended by adding thereto the following sections: |
|
1-3 |
     3-9-12. Alcohol energy drinks. -- No product which combines beer, strong beer or malt |
|
1-4 |
liquor with caffeine, guarana, taurine, or other similar substances which are commonly referred to |
|
1-5 |
as "alcohol energy drinks" may be imported into this state, produced, manufactured, distributed, |
|
1-6 |
sold or offered for sale by a licensed retailer in this state. |
|
1-7 |
     3-9-13. Penalty for violations of section 3-9-12. -- Any person violating the provisions |
|
1-8 |
of section 3-9-12 shall be fined not less than five hundred dollars ($500) nor more than one |
|
1-9 |
thousand dollars ($1,000) or be imprisoned in the adult correctional institution for a period not to |
|
1-10 |
exceed six (6) months. |
|
1-11 |
     3-9-14. Sales of alcohol energy drinks. – Sales of malt beverages containing a |
|
1-12 |
combination of alcohol, caffeine or any other herbal or chemical stimulant currently marketed as |
|
1-13 |
alcohol energy drinks shall be prohibited by an wholesalers or Class A alcohol license holder in |
|
1-14 |
the state of Rhode Island. Wholesalers and retailers shall have thirty (30) days from the date of |
|
1-15 |
passage to remove these products from their shelves. |
|
1-16 |
     3-9-15. Penalty for violation of section 3-9-14. – Any person violating the provisions of |
|
1-17 |
section 3-9-14 shall be fined five hundred dollars ($500) for a first offense. A second offense |
|
1-18 |
shall result in a seven hundred fifty dollar ($750) fine with a loss of license for one day. A third |
|
1-19 |
offense shall result in a thousand dollar ($1,000) fine and a three (3) day consecutive loss of |
|
1-20 |
license. |

2-1 |
     SECTION 2. This act shall take effect upon passage. |
