RELATING TO HEALTH AND SAFETY -- OUTDOOR SMOKING | |

It is enacted by the General Assembly as follows: | |
|

     SECTION 1. Section 23-20.10-3 of the General Laws in Chapter 23-20.10 entitled |
|

"Public Health and Workplace Safety Act" is hereby amended to read as follows: |
|
1-3 |
     23-20.10-3. Prohibition of smoking in public places. – (a) Smoking shall be prohibited |
|
1-4 |
in all enclosed public places within the state of Rhode Island, including, but not limited to, the |
|
1-5 |
following places: |
|
1-6 |
      (1) Aquariums, galleries, libraries and museums; |
|
1-7 |
      (2) Areas available to and customarily used by the general public in businesses and |
|
1-8 |
nonprofit entities patronized by the public, including, but not limited to, professional offices, |
|
1-9 |
banks, laundromats, hotels and motels. |
|
1-10 |
      (3) Bars; |
|
1-11 |
      (4) Bingo facilities when a bingo game is in progress; |
|
1-12 |
      (5) Convention facilities; |
|
1-13 |
      (6) Elevators; |
|
1-14 |
      (7) Facilities primarily used for exhibiting a motion picture, stage, drama, lecture, |
|
1-15 |
musical, recital or other similar performance; |
|
1-16 |
      (8) Health care facilities; |
|
1-17 |
      (9) Licensed child care and adult day care facilities; |
|
1-18 |
      (10) Lobbies, hallways and other common areas in apartment buildings, condominiums, |
|
1-19 |
trailer parks, retirement facilities, nursing homes and other multiple unit residential facilities with |
|
1-20 |
more than four (4) units; |
|
2-1 |
      (11) Polling places; |
|
2-2 |
      (12) Public transportation facilities, including buses and taxicabs, under the authority of |
|
2-3 |
the state of Rhode Island, and ticket, boarding and waiting areas of public transit depots; |
|
2-4 |
      (13) Restaurants; |
|
2-5 |
      (14) Restrooms, lobbies, reception areas, hallways and other common use areas; |
|
2-6 |
      (15) Retail stores; |
|
2-7 |
      (16) Rooms, chambers, places of meeting or public assembly, including school |
|
2-8 |
buildings, under the control of an agency, board, commission, committee or council of the state of |
|
2-9 |
Rhode Island or a political subdivision of the state when a public meeting is in progress, to the |
|
2-10 |
extent the place is subject to the jurisdiction of the state of Rhode Island; |
|
2-11 |
      (17) Schools; including, primary, secondary and post-secondary education facilities; |
|
2-12 |
      (18) Service lines; |
|
2-13 |
      (19) Shopping malls; |
|
2-14 |
      (20) Sports arenas, including outdoor arenas. |
|
2-15 |
     (b) Smoking shall be prohibited in the following unenclosed areas within the state of |
|
2-16 |
Rhode Island: |
|
2-17 |
     (1) Public beaches; |
|
2-18 |
     (2) Public parks; |
|
2-19 |
     (3) Public playgrounds and recreation areas; and |
|
2-20 |
     (4) Pedestrian malls and plazas. |
|
2-21 |
     SECTION 2. This act shall take effect upon passage. |
