RELATING TO HEALTH AND SAFETY -- LICENSING OF HEALTH CARE FACILITIES | |

It is enacted by the General Assembly as follows: | |

     SECTION 1. Chapter 23-17 of the General Laws entitled "Licensing of Health Care |
1-2 |
Facilities" is hereby amended by adding thereto the following section: |

     23-17-58. Defibrillators. -- Every nursing home licensed pursuant to this chapter shall |
1-4 |
have at least one (1) defibrillation device on the premises. These defibrillators will at all times be |
1-5 |
deployed in a manner in which best promotes the availability of and access to the defibrillators by |
1-6 |
the staff. At least one (1) employee of the nursing home trained in the use of an automated |
1-7 |
external defibrillator, must be on duty during normal business hours. Violation of this section by |
1-8 |
a nursing home may result in suspension or revocation of its license. |

     SECTION 2. Chapter 23-17.4 of the General Laws entitled "Assisted Living Residence |
1-10 |
Licensing Act" is hereby amended by adding thereto the following section: |
1-11 |
     23-17.4-35 Defibrillators. -- Every assisted living residence licensed pursuant to this |
1-12 |
chapter shall have at least one (1) defibrillation device on the premises. These defibrillators will |
1-13 |
at all times be deployed in a manner in which best promotes the availability of and access to the |
1-14 |
defibrillators by the staff. At least one (1) employee of the assisted living residence trained in the |
1-15 |
use of an automated external defibrillator, must be on duty during normal business hours. |

Violation of this section by an assisted living residence may result in suspension or revocation of |
1-17 |
its license. |
1-18 |
     SECTION 3. Chapter 23-22.5 of the General Laws entitled "Drowning Prevention and |
1-19 |
Lifesaving" is hereby amended by adding thereto the following section: |

     23-22.5-15 Defibrillators. -- Every swimming pool regulated pursuant to this chapter |
2-2 |
shall have at least one (1) defibrillation device on the premises. These defibrillators will at all |
2-3 |
times be deployed in a manner in which best promotes the availability of and access to the |
2-4 |
defibrillators by the staff. At least one (1) employee of the swimming pool trained in the use of |
2-5 |
an automated external defibrillator, must be on duty during normal business hours. Violation of |
2-6 |
this section shall be subject to the provisions of section 23-22.5-4. |
2-7 |
     SECTION 4. This act shall take effect upon passage. |
