A N A C T

RELATING TO ALCOHOLIC BEVERAGES -- REGULATION OF SALES

It is enacted by the General Assembly as follows:

      SECTION 1. Chapter 3-8 of the General Laws entitled "Regulation of Sales" is hereby

amended by adding thereto the following section:

     3-8-16. Alcohol vaporizing devices prohibited. – (a) Definition. – For the purpose of

this section "Alcohol vaporizing device" or "AWOL" shall mean any device, machine or process

1-5

which mixes liquor, spirits or other alcohol product with pure oxygen or other gas to produce a

1-6

vaporized product for the purpose of consumption by inhalation.

     (b) Violations. – No person shall sell, purchase, possess, use, or offer for sale or use any

1-8

alcohol vaporizing device.

     (c) Penalties. – (1) Any person convicted of a first violation of this section by selling or

1-10

offering to sell any alcohol vaporizing device shall be punished by a fine of not less than three

1-11

hundred fifty dollars ($350) nor more than one thousand dollars ($1,000) and/or imprisoned for a

1-12

period not exceeding six (6) months or both. Any person convicted of a second violation of this

1-13

section by selling or offering to sell any alcohol vaporizing device shall be punished by a fine of

1-14

not less than seven hundred fifty dollars ($750) nor more than one thousand dollars ($1,000)

1-15

and/or imprisoned for a period not exceeding six (6) months, or both.

     (2) Any person convicted of violating this section by purchasing, possessing, using or

offering for use any alcohol vaporizing device shall be punished by a fine of two hundred fifty

1-18

dollars ($250) for the first offense and five hundred dollars ($500) for any subsequent offense.

     (3) Suspension of license for violation. – Any licensee who violates, or permits to be

violated, the provisions of this section is subject to the suspension of license for a period of at

2-2

least three (3) calendar days for the first offense. If additional violations occur, the number of

2-3

calendar days of suspension shall be determined by the department.

     SECTION 2. This act shall take effect upon passage.
