J O I N T R E S O L U T I O N

CREATING A SPECIAL LEGISLATIVE COMMISSION TO STUDY THE FEASIBILITY OF

ESTABLISHING THE OFFICE OF INSPECTOR GENERAL

     RESOLVED, That a special legislative commission be and the same is hereby created

consisting of nineteen (19) members: eight (8) of whom shall be from the House of

Representatives, not more than five (5) from the same political party, to be appointed by the

1-4

Speaker; eight (8) of whom shall be from the Senate, not more than five (5) from the same

1-5

political party, to be appointed by the Senate President; one (1) of whom shall be the Attorney

1-6

General, or designee; one (1) of whom shall be the Governor, or designee; and one (1) of whom

1-7

shall be the General Treasurer, or designee.

     In lieu of any appointment of a member of the legislature to a permanent advisory

1-9

commission, a legislative study commission, or any commission created by a general assembly

1-10

resolution, the appointing authority may appoint a member of the general public to serve in lieu

1-11

of a legislator, provided that the Majority Leader or the Minority Leader of the political party

1-12

which is entitled to the appointment consents to the appointment of the member of the general

1-13

public.

     The purpose of said commission shall be to study the feasibility of establishing the office

1-15

of inspector general as an independent administrative agency charged with the purpose of

1-16

preventing and detecting fraud, waste and abuse, and mismanagement in the expenditure of

1-17

public funds.

     Forthwith upon passage of this resolution, the members of the commission shall meet at

1-19

the call of the Senate President and organize and shall select, from among the legislators, a

2-1

chairperson. Vacancies in said commission shall be filled in like manner as the original

2-2

appointment.

     The membership of said commission shall receive no compensation for their services.

     All departments and agencies of the state shall furnish such advice and information,

2-5

documentary and otherwise, to said commission and its agents as is deemed necessary or

2-6

desirable by the commission to facilitate the purposes of this resolution.

     The Joint Committee on Legislative Services is hereby authorized and directed to provide

2-8

suitable quarters for said commission; and be it further

2-9

     RESOLVED, That the commission shall report its findings and recommendations to the

2-10

General Assembly on or before February 3, 2005 and said commission shall expire on April 3,

2-11

2005.
