RELATING TO COURTS AND CIVIL PROCEDURE -- PARTICULAR ACTIONS --

ARBITRATION

It is enacted by the General Assembly as follows:

     SECTION 1. Section 10-3-16 of the General Laws in Chapter 10-3 entitled "Arbitration"

is hereby amended to read as follows:

     10-3-16. Judgment on award. -- Upon the granting of an order confirming, modifying or

correcting an award, judgment shall be entered in conformity with the award in the court within

1-5

thirty (30) days, unless an appeal is taken as provided in this chapter, in which last case the order

1-6

of the superior court shall pursue the mandate of the supreme court. therewith except as is

1-7

otherwise prescribed in this chapter. Judgment shall include interest at the rate of twelve percent

1-8

(12%) from the date of the award including the principal and interest. Costs of the application

1-9

and of the proceedings subsequent thereto and disbursements may be awarded by the court in its

1-10

discretion. If awarded, the amount shall be included in the judgment. Post judgment interest on

1-11

any award shall continue at the rate of twelve percent (12%) from the date of judgment on the

1-12

arbitration award and thereafter pending any appeals.

     SECTION 2. Section 37-16-22 of the General Laws in Chapter 37-16 entitled "Public

Works Arbitration" is hereby amended to read as follows:

     37-16-22. Entry of judgment -- Costs. -- Upon the granting of an order confirming,

modifying, or correcting an award, judgment may be entered in conformity therewith, except as is

1-17

otherwise prescribed in this chapter. Judgment shall include interest at the rate twelve percent

(12%) from the date of the award including the principal and interest. Costs of the application and

of the proceedings subsequent thereto, not exceeding twenty-five dollars ($25.00) and

2-2

disbursements, may be awarded by the court in its discretion. If awarded, the amount thereof must

be included in the judgment. and disbursements may be awarded by the court in its discretion. If

2-4

awarded, the amount shall be included in the judgment. Post judgment interest on any award shall

continue at the rate of twelve percent (12%) from the date of judgment on the arbitration award

2-6

and thereafter pending any appeals.

     SECTION 3. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would mandate that upon a judgment of an arbitration award, that judgment

would include 12% interest which would accrue from the date of the award.
