RELATING TO HEALTH AND SAFETY -- LYME DISEASE DIAGNOSIS AND | |
TREATMENT | |

It is enacted by the General Assembly as follows: | |

     SECTION 1. Section 5-37.5-2 of the General Laws in Chapter 5-37.5 entitled "Lyme |

Disease Diagnosis and Treatment" is hereby amended to read as follows: |

     5-37.5-2. Preamble. -- WHEREAS, The Governor's Commission on Lyme Disease and |
1-4 |
Other Tick-Borne Diseases (the "Commission") was formed by executive order in 2002; and |
1-5 |
      WHEREAS, The General Assembly recognizes the negative impact of Lyme disease on |
1-6 |
Rhode Islanders; and |
1-7 |
      WHEREAS, Rhode Island has the second highest number of reported Lyme disease |
1-8 |
cases as a percentage of population in the United States; and |
1-9 |
      WHEREAS, The Commission and the General Assembly held hearings and reviewed the |
1-10 |
medical literature to gain an understanding of the concerns of citizens and the medical community |
1-11 |
about Lyme disease diagnosis, treatment and prevention; and |
1-12 |
      WHEREAS, Citizens of Rhode Island diagnosed with chronic lyme disease experience |
1-13 |
great difficulty in being diagnosed and treated thereby impairing their access to medical care; and |
1-14 |
      WHEREAS, The lack of insurance coverage for diagnosis and long-term antibiotic |
1-15 |
therapies is a major barrier to access to medical care for persons with symptoms compatible with |
1-16 |
chronic Lyme disease; and |
1-17 |
      WHEREAS, Physicians whose practices are devoted to treating chronic Lyme disease |
1-18 |
patients, and who continue to provide treatment if they feel such treatment is medically necessary, |

have noted significant improvement in the condition of their patients; and |
2-2 |
      WHEREAS, There is substantial evidence that considerable scientific controversy |
2-3 |
surrounds the diagnosis and treatment of Lyme disease and other tick-borne illnesses; and |
2-4 |
      WHEREAS, Laboratory tests for Lyme disease are not definitive and consensus |
2-5 |
guidelines for diagnosis and treatment of chronic Lyme disease have not been developed; and |
2-6 |
      WHEREAS, Some physicians feel threatened by insurers and licensing boards for their |
2-7 |
choices among possible therapies for their patients; and |
2-8 |
      WHEREAS, The Commission and this General Assembly recommend that legislation be |
2-9 |
adopted that promotes access to medical care for persons with chronic Lyme disease in Rhode |
2-10 |
Island; and |
2-11 |
      Now, therefore, it is enacted by the General Assembly as follows: |
2-12 |
     SECTION 2. Chapter 5-37.5 of the General Laws entitled "Lyme Disease Diagnosis and |
2-13 |
Treatment" is hereby amended by adding thereto the following section: |
2-14 |
     5-37.5-5. Mandatory coverage for certain lyme disease treatments. – Every individual |
2-15 |
or group hospital or medical expense insurance policy or individual or group hospital or medical |
2-16 |
services plan contract delivered, issued for delivery, or renewed in this state on or after January 1, |
2-17 |
2004, shall provide for lyme disease treatment as provided in chapters 27-18, 27-19, 27-20, and |
2-18 |
27-41 of the general laws. |

     SECTION 3. Chapter 27-18 of the General Laws entitled "Accident and Sickness |
2-20 |
Insurance Policies" is hereby amended by adding thereto the following section: |
2-21 |
     27-18-62. Mandatory coverage for certain lyme disease treatments. – (a) Every |
2-22 |
individual or group hospital or medical expense insurance policy or individual or group hospital |
2-23 |
or medical services plan contract delivered, issued for delivery, or renewed in this state on or after |
2-24 |
January 1, 2004 shall provide coverage for diagnostic testing and long-term antibiotic treatment |
2-25 |
of chronic lyme disease when determined to be medically necessary and ordered by a physician |
2-26 |
acting in accordance with chapter 5-37.5 of the Rhode Island General Laws entitled "lyme disease |
2-27 |
diagnosis and treatment" after making a thorough evaluation of the patient's symptoms, |
2-28 |
diagnostic test results and response to treatment. Treatment otherwise eligible for benefits |
2-29 |
pursuant to this section shall not be denied solely because such treatment may be characterized as |
2-30 |
unproven, experimental, or investigational in nature. Provided, however, this section shall not |
2-31 |
apply to insurance coverage providing benefits for: |
2-32 |
     (1) hospital confinement indemnity; |
2-33 |
     (2) disability income; |
2-34 |
     (3) accident only; |
3-1 |
     (4) long-term care; |
3-2 |
     (5) Medicare supplement; |
3-3 |
     (6) limited benefit health; |
3-4 |
     (7) specified disease indemnity; |
3-5 |
     (8) sickness or bodily injury or death by accident or both; and |
3-6 |
     (9) other limited benefit policies. |
3-7 |
     SECTION 4. Chapter 27-19 of the General Laws entitled "Nonprofit Hospital Service |
3-8 |
Corporations" is hereby amended by adding thereto the following section: |
3-9 |
     27-19-53. Mandatory coverage for certain lyme disease treatments. – (a) Every |
3-10 |
individual or group hospital or medical expense insurance policy or individual or group hospital |
3-11 |
or medical services plan contract delivered, issued for delivery, or renewed in this state on or after |
3-12 |
January 1, 2004 shall provide coverage for diagnostic testing and long term antibiotic treatment |
3-13 |
of chronic lyme disease when determined to be medically necessary and ordered by a physician |
3-14 |
acting in accordance with chapter 5-37.5 of the Rhode Island General Laws entitled "lyme disease |
3-15 |
diagnosis and treatment" after making a thorough evaluation of the patient's symptoms, |
3-16 |
diagnostic test results and response to treatment. Treatment otherwise eligible for benefits |
3-17 |
pursuant to this section shall not be denied solely because such treatment may be characterized as |
3-18 |
unproven, experimental, or investigational in nature. |

     SECTION 5. Chapter 27-20 of the General Laws entitled "Nonprofit Medical Service |

Corporations" is hereby amended by adding thereto the following section: |

     27-20-48. Mandatory coverage for certain lyme disease treatments. -- (a) Every |
3-22 |
individual or group hospital or medical expense insurance policy or individual or group hospital |
3-23 |
or medical services plan contract delivered, issued for delivery, or renewed in this state on or after |
3-24 |
January 1, 2004 shall provide coverage for diagnostic testing and long-term antibiotic treatment |
3-25 |
of chronic lyme disease when determined to be medically necessary and ordered by a physician |
3-26 |
acting in accordance with chapter 5-37.5 of the Rhode Island General Laws entitled "lyme disease |
3-27 |
diagnosis and treatment" after making a thorough evaluation of the patient's symptoms, |
3-28 |
diagnostic test results and response to treatment. Treatment otherwise eligible for benefits |
3-29 |
pursuant to this section shall not be denied solely because such treatment may be characterized as |
3-30 |
unproven, experimental, or investigational in nature. |
3-31 |
     SECTION 6. Chapter 27-41 of the General Laws entitled "Health Maintenance |
3-32 |
Organizations" is hereby amended by adding thereto the following section: |
3-33 |
     27-41-65. Mandatory coverage for certain lyme disease treatments. – Subscribers to |
3-34 |
any health maintenance organization plan shall be afforded coverage under that plan on or after |
4-1 |
January 1, 2004 for diagnostic testing and long term antibiotic treatment of chronic lyme disease |
4-2 |
when determined to be medically necessary and ordered by a physician acting in accordance with |
4-3 |
chapter 5-37.5 of the Rhode Island General Laws entitled "lyme disease diagnosis and treatment" |
4-4 |
after making a thorough evaluation of the patient's symptoms, diagnostic test results and response |
4-5 |
to treatment. Treatment otherwise eligible for benefits pursuant to this section shall not be denied |
4-6 |
solely because such treatment may be characterized as unproven, experimental, or investigational |
4-7 |
in nature. |
4-8 |
     SECTION 7. This act shall take effect upon passage. |
