A N A C T

RELATING TO PRIVATE SCHOOLS

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 16-40 of the General Laws entitled "Private Schools" is hereby

amended by adding thereto the following section:

      16-40-17. Participation by private school students in public school sports program.

-- Any student attending a private elementary or secondary school within the state and the

1-5

student wishes to participate and compete as a member of a school sports team, and the private

1-6

school does not sponsor, field or maintain a team in that sport, may participate and compete on a

1-7

team sponsored, fielded or maintained by the public school that said student would be eligible to

1-8

attend without charge because of his or her residency in a city or town. The student may compete

1-9

on the team without payment of any fees other than those fees required of a student enrolled in

1-10

the public school. The private school student shall be subject to the same rules, regulations, and

1-11

obligations applicable to all public school students.

1-12

      The provisions of this section shall apply only to those sports for which a league is

1-13

sponsored by the Rhode Island Interscholastic League.

     SECTION 2. This act shall take effect upon passage.

     This act would permit students who attend a private school to participate as a member of

a public school team if their private school does not field a team in that sport.

      This act would take effect upon passage.
