A N A C T

RELATING TO LIABILITY INSURANCE -- RENTAL VEHICLES

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 27-7 of the General Laws entitled "Liability Insurance" is hereby

amended by adding thereto the following section:

     27-7-6. Rental vehicle coverage. -- No policy insuring against loss for property damage

1-4

caused by collision arising out of the ownership, maintenance or use of a motor vehicle shall be

1-5

delivered or issued for delivery in this state with respect to any motor vehicle registered or

1-6

principally garaged in this state unless coverage is provided therein or supplemental thereto, that

1-7

all of the obligation for damage and loss of use to a rented passenger vehicle including pickup

1-8

truck, van, and rented truck with a registered gross vehicle weight of twenty-six thousand

1-9

(26,000) pounds or less shall be covered by the said property damage liability provision and the

1-10

said obligation under this section shall not be contingent on fault or negligence and said coverage

1-11

shall in no instance be less than the limits set forth in section 31-31-7 or 31-32-24 under

1-12

provisions approved by the insurance commissioner.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO LIABILITY INSURANCE -- RENTAL VEHICLES

     This act would require that policies of insurance for loss of property damage caused by

collision shall cover all damage and loss of use to rented passenger vehicles or trucks. Property

2-3

damage liability obligation shall not be contingent on fault or negligence.

     This act would take effect upon passage.
