RELATING TO LIABILITY INSURANCE -- RENTAL VEHICLES | |

It is enacted by the General Assembly as follows: | |

SECTION 1. Chapter 27-7 of the General Laws entitled "Liability Insurance" is hereby |
|

amended by adding thereto the following section: |
|

27-7-6. Rental vehicle coverage. -- No policy insuring against loss for property damage |
|
1-4 |
caused by collision arising out of the ownership, maintenance or use of a motor vehicle shall be |
|
1-5 |
delivered or issued for delivery in this state with respect to any motor vehicle registered or |
|
1-6 |
principally garaged in this state unless coverage is provided therein or supplemental thereto, that |
|
1-7 |
all of the obligation for damage and loss of use to a rented passenger vehicle including pickup |
|
1-8 |
truck, van, and rented truck with a registered gross vehicle weight of twenty-six thousand |
|
1-9 |
(26,000) pounds or less shall be covered by the said property damage liability provision and the |
|
1-10 |
said obligation under this section shall not be contingent on fault or negligence and said coverage |
|
1-11 |
shall in no instance be less than the limits set forth in section 31-31-7 or 31-32-24 under |
|
1-12 |
provisions approved by the insurance commissioner. |

SECTION 2. This act shall take effect upon passage. |

This act would require that policies of insurance for loss of property damage caused by |

collision shall cover all damage and loss of use to rented passenger vehicles or trucks. Property |

damage liability obligation shall not be contingent on fault or negligence. |

This act would take effect upon passage. |
