MAKING REVISED APPROPRIATIONS FOR THE SUPPORT OF THE STATE FOR THE FISCAL YEAR ENDING JUNE 30, 2000

It is enacted by the General Assembly as follows:
ARTICLE 1
MAKING REVISED APPROPRIATIONS IN SUPPORT OF FY 2000
SECTION 1. There is hereby appropriated, out of any money in the treasury not otherwise appropriated, to be expended during the fiscal year enB2000 Hforsums to be the sole change to any sum heretofore appropriated for the same fiscal year, notwithstanding the provisions of Section 22.2 of Chapter 4 and Section 15 of Chapter 3 of Title 35 of the Rhode Island General Laws and Section 6 of Chapter 41 of Title 42, of the Rhode Island General Laws. The s t a t e co n tro l l e r is h e r eby authorized to draw his or her orders upon the general treasurer for the payment of such sum, or so much thereof as may be required from time to time, upon receipt of properly authenticated vouchers.

SECTION 2. The State of Rhode Island is hereby authorized to borrow during its fiscal year ending June 30, 2001, in anticipation of receipts from taxes such sum or sums, at such time or times and upon such terms and conditions not inconsistent with the provisions and limitations of section 17 of article VI of the constitution of Rhode Island, as the general treasurer, with the advice of the Governor, shall deem for the best interests of the state, provided that the amounts so borrowed shall not exceed one hundred fifty million dollars ( $150,000,000), at any time outstanding. The state is hereby further authorized to give its promissory note or notes signed by the general treasurer and counter-signed by the secretary of state for the payment of any sum so borrowed. Any such proceeds shall be invested by the general treasurer until such time as they are needed. The interest income earned from such investments shall be used to pay the interest on the promissory note or notes, and any expense of issuing the promissory note or notes, with the balance remaining at the end of said fiscal year, if any, shall be used toward the payment of long term debt service of the state, unless prohibited by federal law or regulation.
Notwithstanding any other authority to the contrary, duly authorized bonds or notes of the state issued during the fiscal year ending June 30, 2001 may be issued in the form of commercial paper, so-called. In connection herewith, the state, acting through the general treasurer, may enter into agreements with banks, trust companies or other financial institutions within or outside the state, whether in the form of letters or lines of credit, liquidity facilities, insurance or other support arrangements. Any notes issued as commercial paper shall be in such amount and bear such terms as the general treasurer, with the advice of the governor, shall determine, which may include provisions for prepayment at any time with or without premium at the option of the state. Such notes may be sold at a premium or discount, and may bear interest or not and, if interest bearing, may bear interest at such rate or rates variable from time to time as determined by the Federal Reserve Bank Composite Index of Commercial Paper, or the Municipal Market Data General Market Index or other similar commercial paper offerings, or other method specified in any agreement with brokers for the placement or marketing of any such notes issued as commercial paper, or other like agreements. Any such agreement may also include such other covenants and provisions for protecting the rights, security and remedies of the lenders as may, in the discretion of the general treasurer, be reasonable and proper and be reasonable, legal and proper. The general treasurer may also enter into agreements with brokers for the placement or marketing of any such notes of the state issued as commercial paper. Any notes of the state issued as commercial paper in anticipation of receipts from taxes in any fiscal year must also be issued in accordance with the provisions of section 17 of article VI of the constitution of Rhode Island and within the limitations set forth in section 1 of this act.
SECTION 3. Mental Health and Retardation: Notwithstanding the provisions of Section 35-3-15 of Chapter 35 of the Rhode Island General Laws, all unexpended and unencumbered balances as of June 30, 2000 relating to the Pirovano Trust in the Department of Mental Health, Retardation are hereby reappropriated to f i scal year 2001.
SECTION 4. Departments and agencies listed below may not exceed the number of full time equivalent (FTE) positions shown below in any pay period. Full-time equivalent positions do not include seasonal or intermittent positions whose scheduled period of employment does not exceed twenty-six consecutive weeks or whose scheduled hours do not exceed nine hundred and twenty-five (925) hours, excluding overtime, in a one-year period. Nor do they include individuals engaged in training, the completion of which is a prerequisite of employment.
Provided, however, that the Governor, Speaker of the House of Representatives and the Majority Leader of the Senate may authorize an adjustment to any limitation. Prior to the authorization, the State Budget Officer shall make a detailed written recommendation to the Governor, the Speaker of the House, and the Senate Majority Leader. A copy of the recommendation and authorization to adjust shall be transmitted to the Chairman of the House Finance Committee, Senate Finance Committee, the House Fiscal Advisor and the Senate Fiscal Advisor.

SECTION 5. This article shall take effect upon passage.
ARTICLE 2
RELATING TO PROPERTY TAX RELIEF
SECTION 1. Section 44-33-2.1 of the General Laws in Chapter 44-33 entitled "Property Tax Relief" is hereby amended to read as follows:
§ 44-33-2.1 Property tax relief - Limitation. - (a) Appropriations from the general fund for property tax relief provided by this chapter are in the amount of five million five hundred thousand dollars ($5,500,000) for fiscal years 2000 and 2001 and six million dollars($6,000,000) for fiscal year 1998-1999 2002 and for each subsequent fiscal year.
(b) A claimant sixty-five (65) years of age or older, and/or disabled during any portion of the year for which the claim was filed is paid in full upon receipt of his or her claim for relief under this chapter.
(c) The tax administrator shall not pay any claims to claimants who were under sixty-five (65) years of age or not disabled on the last day of the taxable year for which the claim is made until the total amount of all timely-filed claims has been paid under subsection (b). This balance shall be determined as of June 30 annually less the sum of fifty thousand dollars ($50,000) annually for payment of late-filed claims approved by the tax administrator under § 44-33-18.
(d) If insufficient funds exist as of June 30 annually to pay the full amount of all claims of persons under sixty-five (65) years of age and/or not disabled on the last day of the taxable year for which the claim is made, the tax administrator shall make payments to each claimant proportionately. No payment shall exceed one hundred percent (100%) of the amount of the claim.
(e) Late-filed claims approved under § 44-33-18 for claimants sixty-five (65) years of age or older and/or disabled are paid in full upon receipt of his or her claim for relief under this chapter. Late-filed claims approved under § 44-33-18 for claimants under sixty-five (65) years of age and/or not disabled are paid at the same percentage as determined under subsection (d).
SECTION 2. This article shall be effective July 1, 1999.
ARTICLE 3
RELATING TO MOTOR VEHICLE EMISSIONS INSPECTION PROGRAM
SECTION 1. Section 31-47.1-11 of the General Laws in Chapter 31-47.1 entitled "Motor Vehicle Emissions Inspection Program" is hereby amended to read as follows:
§ 31-47.1-11 Fees. - (a) A fee, established in accordance with the rules and regulations of the department as provided in § 31-47.1-7(b) hereof, is to be charged for each motor vehicle inspected. The amount of fees collected shall provide for the cost of the inspection, the costs of administering the motor vehicle emissions inspection program and other costs provided by law. The fee must be paid for each motor vehicle inspected at an emissions inspection station at the time of the inspection and is payable whether a compliance certificate, waiver certificate, or no certificate is issued. There shall be no fee charged for one reinspection of a vehicle that failed an initial inspection when the reinspection is conducted at the AIRS that conducted the initial inspection.
(b) The motor vehicle emission inspection account is hereby established within the general fund as a restricted receipt account. The costs of operating the motor vehicle emission inspection program shall be charged to this restricted receipt account and all revenues not required for the operation of this program shall be deposited as general revenues and will continue until June 30, 2003. at which time For the fiscal year commencing July 1, 2003, all emission inspection fees shall be deposited as general revenues. Revenues received in the restricted receipt account shall be exempt from the indirect cost recoveries on restricted receipt accounts required under section 35-4-27 of the General Laws. The motor vehicle emission inspection account shall be used to pay all the costs of administering the motor vehicle emission inspection programs of the department and the department of environmental management according to the requirements of 40 CFR 51.354(a). It is the intent of this section that the motor vehicle emission inspection program be self supporting.
(c) The general assembly shall on or before June 30th of each calendar year review the costs and fees associated with the program with the goal of eliminating all fees being directed to the general fund and to eliminate all costs and fees not directly related and necessary to pay the costs of administering the motor vehicle emission inspection program as required under 40 CFR 51.354(a).
SECTION 2. This article shall be effective July 1, 1999.
RELATING TO INDEBTEDNESS OF TOWNS AND CITIES
§ 45-12-4.4 Borrowing in payment of certain judgments. - (a) A city or town may issue bonds, notes, or other evidences of indebtedness in an amount not to exceed four million dollars ($4,000,000) to pay the uninsured portion of any court judgment or settlement: (1) arising out of any litigation for which the general assembly has by special legislation increased the maximum amounts permitted for recovery against a city or town beyond the amounts otherwise recoverable; or (2) arising out of a general revaluation of real property within the city or town conducted pursuant to § 44-5-11; provided, however, that the town of Cumberland and the city of Providence may issue bonds, notes, or other evidences of indebtedness pursuant to the terms of this section to pay the uninsured portion of any court judgment or settlement arising out of any litigation against the town of Cumberland or against the city of Providence in an amount not to exceed $6,500,000 notwithstanding that the general assembly has not by special legislation increased the maximum amount permitted for recovery against the town of Cumberland or the city of Providence beyond the amounts otherwise recoverable.
(b) These bonds, notes, or other evidences of indebtedness are subject to the maximum aggregate indebtedness permitted to be issued by any city or town under § 45-12-2.
(c) The bonds, notes, or other evidences of indebtedness may be issued to pay a judgment or settlement or may be issued to pay or refund notes issued under § 45-12-4.1.
(d) The denominations, maturities, interest rates, methods of sale, and other terms, conditions, and details of any bond, note, or hiring under the provisions of this section may be fixed by the vote or resolution of the city or town council authorizing them, or if no provision is made in the vote or resolution, by the city or town council, or in the absence of any of the foregoing, by the treasurer or other officer authorized to issue the bonds or notes or to hire the money; provided, that the payment of principal of bonds shall be by sufficient annual payments that will extinguish the debt at maturity, the first of these annual payments to be made not later than one year, and the last payment not later than fifteen (15) years after the date of the bonds.
(e) The bonds, notes, or other evidences of indebtedness may be issued under this section by any political subdivision without obtaining the approval of its electors, notwithstanding the provisions of §§ 45-12-19 and 45-12-20 and notwithstanding any provision of its charter to the contrary, unless the electors when assembled in a meeting are the local legislative body for the purpose of authorizing indebtedness of the political subdivision.
SECTION 2: This article shall take effect upon passage.

Explanation of Articles
ARTICLE 1
MAKING REVISED APPROPRIATIONS IN SUPPORT OF FY 2000
This article revises appropriations for fiscal year 2000 for general revenues, federal funds, restricted receipts, and other funds. This article also amends FTE authorizations for fiscal year 2000; provides statutory authorization for the General Treasurer to borrow in anticipation of taxes for cash flow purposes during fiscal year 2001; and reappropriates all unexpended Pirovano Trust balances for the Department of Mental Health, Retardation, and Hospitals to fiscal year 2001.
ARTICLE 2
RELATING TO PROPERTY TAX RELIEF
This article reduces the annual appropriation for the Property Tax Relief program from $6.0 million to $5.5 million in both fiscal years 2000 and 2001. The appropriation will return to $6.0 million in fiscal year 2002 and each fiscal year thereafter.
ARTICLE 3
RELATING TO MOTOR VEHICLE EMISSIONS INSPECTION PROGRAM
This article clarifies the allocation of revenues generated from the new Emissions Inspection fee and assures that the state general fund continues to receive its share of this fee.
ARTICLE 4
RELATING TO INDEBTEDNESS OF TOWNS AND CITIES
This article allows the City of Providence to borrow up to $6.5 million, which the City proposes to do, in order to pay the amount due to the State of Rhode Island pursuant to the Supreme Court order relating to the Capital Properties litigation.
