A N     A C T

RELATING TO HEALTH AND SAFETY -- PUBLIC RESTROOMS

It is enacted by the General Assembly as follows:

SECTION 1. Title 23 of the General Laws entitled "Health and Safety" is hereby amended by adding thereto the following chapter:

CHAPTER 23-72
PUBLIC RESTROOMS IN RESTAURANTS

23-72-1. Requirement of public restrooms. -- (a) The state department of health is hereby authorized to require that all restaurants, who serve patrons for consumption of food on the premises, have a public restroom. Restaurants which serve on strictly a "take-out" basis shall be exempt from this section.

(b) The department of health shall promulgate rules and regulations for the enforcement of this section.

(c) Whoever violates the provisions of this section, or any rule or regulation of the state department of health made under authority hereof, shall be guilty of a misdemeanor and may be fined not more than twenty-five dollars ($25.00) per day and each day of noncompliance shall be a separate offense.

SECTION 2. This act shall take effect on January 1, 2001.

This act would require all "eat-in" restaurants to have a public restroom.

This act would take effect January 1, 2001.
