RELATING TO CRIMINAL OFFENSES - TRESPASS AND VANDALISM | |

It is enacted by the General Assembly as follows: | |

     SECTION 1. Chapter 11-44 of the General Laws entitled "Trespass and Vandalism" is |
|

hereby amended by adding thereto the following sections: |
|
1-3 |
     11-44-33. Trespassing and vandalism offenses on Providence water property. -- Any |
|
1-4 |
person who willfully engages in trespassing, fishing, boating, biking, camping, picnicking, |
|
1-5 |
skating, bathing, trapping, hunting, smoking, building fires, using a firearm, or using a motor |
|
1-6 |
vehicle on restricted Providence water property, or engaging in any acts tending to pollute the |
|
1-7 |
water or injure the property belonging to Providence water, shall be fined twenty dollars ($20.00) |
|
1-8 |
for every offense. |
|
1-9 |
     11-44-34. Enforcement of trespassing and vandalism offenses on Providence water |
|
1-10 |
property. -- Any Providence water watershed inspector, viewing any offense committed in |
|
1-11 |
violation of section 11-44-33, shall issue a citation to the offender for each infraction observed. |
|
1-12 |
The Providence municipal court shall have jurisdiction over all such offenses. |

1-13 |
     SECTION 2. This act shall take effect upon passage. |

     This act would punish any trespass on to restricted Providence water property, would |
|

prohibit a variety of outdoor activities on restricted Providence water property, and would further |
|
2-3 |
prohibit engaging in any act on restricted Providence water property that would tend to pollute |
|
2-4 |
the water or injure the property of Providence water. Each offense would be punishable by a |
|
2-5 |
twenty dollar ($20.00) fine, and jurisdiction of these offenses shall be with the Providence |
|
2-6 |
municipal court. |

2-7 |
     This act would take effect upon passage. |
