RELATING TO BUSINESSES AND PROFESSIONS -- CONTRACTORS' REGISTRATION | |
AND LICENSING BOARD | |

It is enacted by the General Assembly as follows: | |

     SECTION 1. Chapter 5-65 of the General Laws entitled "Contractors' Registration and |

Licensing Board" is hereby amended by adding thereto the following section: |

     5-65-11.1. Warranties. – (a) Any contractor registered or required to be registered |
1-4 |
pursuant to this chapter shall warrant for three (3) years to any purchaser of a new structure or to |
1-5 |
the owner of an existing structure that the structure is suitable for the ordinary uses of real estate |
1-6 |
of its type and that any improvements made or contracted for or by the contractor will be: |
1-7 |
     (1) free from defective materials; and |
1-8 |
     (2) constructed in accordance with applicable law, according to sound engineering and |
1-9 |
construction standards, and in a workmanlike manner. |
1-10 |
     (b) In addition to all other remedies imposed pursuant to this chapter, when the board has |
1-11 |
concluded that a contractor has violated the provisions of this section, the prevailing party shall |
1-12 |
also recover reasonable attorneys fees. |
1-13 |
     SECTION 2. This act shall take effect upon passage. |
