RELATING TO THE RHODE ISLAND PUBLIC CORPORATION DEBT MANAGEMENT | |

ACT AND APPROVING THE SUBLEASE AGREEMENT BETWEEN THE STATE OF | |

RHODE ISLAND ACTING THROUGH THE DEPARTMENT OF HUMAN SERVICES AND | |

THE CITY OF PAWTUCKET | |

     WHEREAS, The city of Pawtucket and the Rhode Island department of human services, |
|

currently lease by and between the state of Rhode Island, acting through the department of human |
|
1-3 |
services and the city of Pawtucket, the premises located at 24 Commerce Street, Pawtucket, |
|
1-4 |
Rhode Island; and |
|
1-5 |
      WHEREAS, The department of human services and the city of Pawtucket have |
|
1-6 |
negotiated a new lease (the "Lease Agreement") that consists of the city of Pawtucket leasing the |
|
1-7 |
premises at 24 Commerce Street from Kellaway Realty Corporation of Randolph, Massachusetts, |
|
1-8 |
and subsequently subleasing the premises to the department of human services (DHS) for the |
|
1-9 |
operation of the Pawtucket Office for the state department of human services, an essential public |
|
1-10 |
facility; and |
|
1-11 |
      WHEREAS, The purpose of the Lease Agreement is to house the department of human |
|
1-12 |
services Pawtucket Regional Family Center; and |
|
1-13 |
      WHEREAS, The current annual rental cost is $271,040, with the state responsible for |
|
1-14 |
50% of the total rent; and |
|
1-15 |
      WHEREAS, The range of annual costs over the five year term of the Lease Agreement |
|
1-16 |
would be $150,660-$169,560, which depicts the state's share of 50% of the total cost; and |
|
1-17 |
     WHEREAS, The terms of the current lease expire on June 30, 2007. The proposed Lease |
|
1-18 |
Agreement would constitute an extension on this existing lease for a term of five (5) years; and |
|

      WHEREAS, On June 12, 2007, the State properties committee approved the Lease |
|
2-2 |
Agreement by and between the State of Rhode Island acting through the department of human |
|
2-3 |
services and the city of Pawtucket for said premises located at 24 Commerce Street, Pawtucket, |
|
2-4 |
Rhode Island, pending approval of the general assembly; and |
|
2-5 |
     WHEREAS, The five (5) year term of the Lease Agreement does not exceed the |
|
2-6 |
provisions of Rhode Island general law subsection 37-6-2(d); provided, however, the state’s share |
|
2-7 |
of the costs for the rental space, currently $150,660, and rising to $169,560 over the term of the |
|
2-8 |
Lease Agreement, exceeds the statutory limit of $500,000, thereby requiring additional approval; |
|
2-9 |
and |
|
2-10 |
     WHEREAS, Rhode Island general laws sections 35-18-3 and 35-18-4 set forth the |
|
2-11 |
requirement of prior approval of the Lease Agreement by the general assembly through passage |
|
2-12 |
of a concurrent joint resolution; now, therefore be it |
|
2-13 |
     RESOLVED, That this general assembly hereby approves this Lease Agreement between |
|
2-14 |
the city of Pawtucket and the Rhode Island department of human services for the premises |
|
2-15 |
located at 24 Commerce Street, Pawtucket, Rhode Island; and be it further |
|
2-16 |
     RESOLVED, That this Joint Resolution shall take effect upon passage; and be it further |
|
2-17 |
     RESOLVED, That the secretary of state be and he hereby is authorized and directed to |
|
2-18 |
transmit duly certified copies of this resolution to the chairperson of the state properties |
|
2-19 |
committee, Michael Cassidy, director of the Pawtucket department of planning and development, |
|
2-20 |
and the director of the department human services. |
