It is enacted by the General Assembly as follows:
SECTION 1. Section 31-19.3-5 of the General Laws in Chapter 31-19.3 entitled "Regulation of Rental of Motorized Bicycles and Motorized Tricycles in New Shoreham", as amended by Chapter 158 of the 1992 Public Laws entitled "An Act Relating to Motor Vehicles" is hereby amended to read as follows:
{ADD 31-19.3-5. Ordinances. [Version as amended by P.L. 1992, ch. 158 Section 1; contingently effective; see note.] -- ADD} The town council of the town of New Shoreham may enact reasonable ordinances establishing procedures and standards for the licensing, supervision, regulation and control of the rental of motorized bicycles and motorized tricycles.
An ordinance enacted pursuant to this section may:
(a) Establish a fee to be charged for the issuance or renewal of any license for the rental of motorized bicycles and/or motorized tricycles. The fee shall be based on the total number of motorized bicycles and/or motorized tricycles. The holder of the license is authorized to rent or lease and shall not exceed the sum of {DEL fifteen dollars ($15.00) DEL} {ADD forty dollars ($40.00) ADD} per motorized bicycle or motorized tricycle.
(b) Establish a maximum number of licenses which may be granted for the rental of motorized bicycles and/or motorized tricycles.
(c) Establish hours during which motorized bicycles and/or motorized tricycles may be rented.
(d) Establish a maximum number of motorized bicycles and/or motorized tricycles which a license holder may rent or lease under the license.
(e) Provide that no motorized bicycle or motorized tricycle shall be rented or leased in the town of New Shoreham unless the operator thereof has a valid license issued under the provisions of section 31-10-1, or a similar license issued by a state other than Rhode Island.
(f) Require all motorized bicycles and/or motorized tricycles to pass inspection annually and be issued a certificate by a duly authorized state inspection facility indicating that the vehicle has passed inspection {DEL . These state DEL} {ADD to be conducted at ADD} inspection agencies {ADD which ADD} shall be created and governed by rules {ADD and regulations ADD} promulgated by the Rhode Island state department of transportation.
SECTION 2. Section 31-19.3-5 of the General Laws in Chapter 31-19.3 entitled "Regulation of Rental of Motorized Bicycles and Motorized Tricycles in New Shoreham", as amended by Chapter 159 of the 1992 Public Laws entitled "An Act Relating to Mopeds and Tripeds" is hereby repealed in its entirety.

The fee shall be based on the total number of motorized bicycles and/or motorized tricycles the holder of the license is authorized to rent or lease and shall not exceed the sum of fifteen dollars ($15.00) per motorized bicycle or motorized tricycle.
(b) Establish a maximum number of licenses which may be granted for the rental of motorized bicycles and/or motorized tricycles.
(c) Establish hours during which motorized bicycles and/or motorized tricycles may be rented.
(d) Establish a maximum number of motorized bicycles and/or motorized tricycles which a license holder may rent or lease under the license.
(e) Require that each person, firm or corporation engaging in the business of renting or leasing motorized bicycles or motorized tricycles shall make available to each renter thereof eye protection and helmets of the type approved by the registrar of motor vehicles as set forth by the registrar in rules and regulations promulgated in accordance with section 31-10.1-4 and that all persons operating motorized bicycles and motorized tricycles must wear such eye protection and helmets.
(f) Provide that no motorized bicycle or motorized tricycle shall be rented or leased in the town of New Shoreham unless the operator thereof has a valid license issued under the provisions of section 31-10-1, or a similar license issued by a state other than Rhode Island. DEL}
SECTION 3. This act shall take effect upon passage.
