A N     A C T

RELATING TO STATE AFFAIRS AND GOVERNMENT -- RHODE ISLAND HUMAN RESOURCE INVESTMENT COUNCIL

It is enacted by the General Assembly as follows:

SECTION 1. Sections 42-102-2 and 42-102-4 of the General Laws in Chapter 42-102 entitled "Rhode Island Human Resource Investment Council" are hereby amended to read as follows:

42-102-2. Composition of council. -- The council shall be composed of twenty-seven (27) members of whom no less than one- third (1/3) shall be women as follows:

(a) One shall be appointed by the governor from the nongovernmental sector to serve as chair of the council;

(b) Eight (8) shall be appointed by the governor from the employer community, two (2) of whom shall be from the nonprofit sector, and at least two (2) of whom must be women from the following employer groups:

(i) Two (2) from companies with less than twenty-five (25) employees;

(ii) Two (2) from companies with twenty-five (25) to two hundred fifty (250) employees;

(iii) Two (2) from companies with more than two hundred fifty (250) employees; and

(iv) Two (2) from minority-owned companies;

(c) Three (3) members from organized labor shall be appointed by the governor;

(d) One member from a community-based organization representing minorities shall be appointed by the governor;

(e) One {DEL member from the handicapped population shall be appointed by the governor DEL} {ADD individual who serves as the chair of the governor's commission on disabilities ADD};

(f) Six (6) individuals shall serve on the council by virtue of their respective positions as chairs of the following organizations:

(i) Three (3) individuals, who serve as chairs of their respective private industry councils;

(ii) One individual who serves as chair of the Rhode Island {DEL federation of chambers of commerce; DEL} {ADD state apprenticeship council; and ADD}

{DEL (iii) One individual who serves as chair of the state council on vocational education; and DEL}

{DEL (iv) DEL} {ADD (iii) ADD} One individual who serves as chair of the pathways to independence advisory council;

(g) The senate majority leader and the speaker of the house shall appoint one individual each from their respective chambers to become members of the council; and

(h) The directors or commissioners of the following five (5) departments shall serve on the council: employment and training, economic development, human services, elementary and secondary education, and higher education.

{ADD (i) The executive director of the Rhode Island economic policy council shall serve on the council. ADD}

42-102-4. Terms of office and voting. -- (a) Of the thirteen (13) nongovernmental members appointed by the governor, seven (7) shall be appointed for a term of two (2) years, and six (6) shall be appointed for three (3) years. After the initial appointments of those individuals serving two (2) year terms, they or their successors shall be appointed to three (3) year terms. A vacancy in the office of a member, other than by expiration of said member's term, shall be filled in like manner as the original appointment, but only for the remainder of the prevailing term. Members whose terms expire may be reappointed. Individuals whose memberships are based on their roles as chairs of specific councils shall serve for the duration of their term of office in the function and organization they represent.

(b) Only members and authorized designees shall have the right to vote. {DEL Only directors or commissioners from the departments of labor and training, economic development, human services, elementary and secondary education, and higher education are permitted to designate an individual to represent them at council meetings. DEL}

{ADD Only the following members shall be permitted to designate an individual to represent them at council meetings: ADD}

{ADD (i) The directors or commissioners from the departments of labor and training, economic development, human services, elementary and secondary education, and higher education; ADD}

{ADD (ii) The executive director of the Rhode Island economic policy council; ADD}

{ADD (iii) The chair of the Rhode Island state apprenticeship council; and ADD}

{ADD (iv) The chair of the governor's commission on disabilities. ADD}

SECTION 2. Sections 28-45-9.1, 28-45-13.1 and 28-45-16 of the General Laws in Chapter 28-45 entitled "Apprenticeship Programs in Trade and Industry" are hereby amended to read as follows:

28-45-9.1. Apprenticeship programs -- Fees. -- A fee of one hundred dollars ($100) shall be paid by each program sponsor, {ADD except those sponsors who are in registered school-to- career apprenticeship programs only, ADD} requesting authorization as an approved sponsor from the state apprenticeship council. All state approved sponsors' certificates issued by the division of professional regulation {ADD except those sponsors who are registered in school-to-career apprenticeship programs only, ADD} shall become due for renewal annually upon payment of a renewal fee of one hundred dollars ($100). Such fees shall be deposited as general revenues.

28-45-13.1. Apprenticeship registration -- Fees. -- A fee of twenty dollars ($20.00) shall be paid by each indentured apprentice {ADD , except those apprentices who are registered in school-to-career apprenticeship programs only, ADD} not registered as an apprentice with the division of professional regulation of the department of labor {ADD and training ADD}, {ADD except those apprentices who are registered in school-to-career apprenticeship programs only, ADD} requesting approval and registration with the state apprenticeship council. All state approved apprentice certificates that are not registered and renewable through the division of professional regulation of the department of labor {ADD and training ADD} shall become due for renewal annually for a renewal fee of twenty dollars ($20.00). All apprenticeship certificates issued by the division of professional regulation of the department of labor {ADD and training ADD}shall expire on the indentured date of the individual qualifying for the certificate.

{ADD 28-45-16. Reciprocity. -- ADD} {DEL Apprenticeship programs and standards of employers and unions in other than the building and construction industry which jointly form a sponsoring entity on a multistate basis and are registered in conformity with all requirements of this chapter by any recognized state apprenticeship agency or council or by the bureau of apprenticeship and training, employment and training administration shall be accorded registration or approval reciprocity by the apprenticeship council if that reciprocity is requested by the sponsoring entity. DEL}

(a) When a sponsor of an apprenticeship program which is registered and operating in a neighboring state requests registration from the department to train apprentices for work projects in this state, the sponsor shall be granted registration providing the sponsor conforms with the regulations and standards of the State of Rhode Island.

(b) An apprentice registered in an approved registered apprenticeship program in a neighboring state will be awarded certification of registration for state purposes upon request and on the condition that the neighboring state's sponsorship program is registered with the appropriate state apprentice agency.

(c) The State Apprenticeship Council shall have the authority to expand or limit the number of states that are subject to the provisions of subsection (a) as provided herein by regulation through the promulgation of rules and regulations.

SECTION 3. This act shall take effect upon passage.
