A N     A C T

RELATING TO CRIMINAL PROCEDURE -- VICTIM'S RIGHTS

It is enacted by the General Assembly as follows:

SECTION 1. Section 12-28-4.2 of the General Laws in Chapter 12-28 entitled "Victim's Rights" is hereby amended to read as follows:

12-28-4.2. Representative of incapacitated victim. -- A member of the immediate family of a victim {ADD who is under the age of twelve (12) at the time of sentencing ADD} {ADD or ADD} who is unable to exercise the rights established by this chapter personally, due to {DEL physically DEL} {ADD physical ADD} incapacity resulting from the crime, shall, upon request, be afforded the opportunity to exercise those rights on the victim's behalf.

SECTION 2. This act shall take effect upon passage.
