ESTABLISHING THE

It is enacted by the
General Assembly as follows:
SECTION 1. Section 4 of Chapter 13 of the 2001 Public Laws
entitled "An Act
Establishing the Smithfield
Land Trust" is hereby amended as follows:
SECTION
4. The trust shall be administered by seven (7) regular trustees
appointed by
the town council each. The trustees who are
first appointed shall be designated to serve for terms
of two (2) for one (1), two (2) for two (2), three (3),
four (4) and five (5) years respectively.
Thereafter trustees shall be appointed as aforesaid for a term of office of five (5) years except that
all vacancies occurring during a term shall be filled for
the unexpired term. In addition, there shall
be two (2) alternate trustees, designated first
alternate and second alternate by the town council,
who shall be appointed by the town council for one year
terms and who may participate in all
meetings and serve on committees. As described herein,
alternate trustees may vote on an issue
when less than four (4) regular trustees are present and
able to vote on that issue. If only three (3)
regular trustees are present and able to vote on an issue,
the first alternate may vote, if present and
able, and if not present and able, then the second
alternate may vote on the issue. If only two (2)
regular trustees are present and able to vote on an issue,
then both the first alternate and the
second alternate may vote on that issue. In addition to the seven (7) regular trustees and
two (2)
alternate trustees
appointed by the town council, the current chairperson or member designee of
the Smithfield Conservation Commission and Smithfield
Planning Board shall also be nonvoting,
ex officio trustees. Trustees shall be electors of the
town of
compensation and shall hold office until their successors have
been named. No trustee may be an
elected officer or salaried employee of the town of
