RELATING TO
STATE AFFAIRS AND GOVERNMENT -- STATE POLICE

It is enacted by the General
Assembly as follows:
SECTION 1. Chapter 42-28 of the General Laws entitled
"State Police" is hereby
amended by adding thereto the following section:
42-28-11.1. Local
police officers assigned to state police. -- Local police officers
assigned to the state police for the purposes of assignment on
a statewide task force shall exercise
the same powers of arrest exercised by a sworn member of
the state police only when working on
an investigation authorized under the authority of the
superintendent of the state police and only
when said arrest power is exercised in the local police
officer’s capacity as a member of the
statewide task force. If a local police officer is assigned to
a statewide task force for the purpose
of investigation into criminal matters, generally, he or
she shall exercise the same powers of
arrest exercised by a sworn member of the state police only
when working on an investigation
authorized under the authority of the superintendent of the
state police. The authorization for such
local police officers acting under the authority of this
statute shall be on file with the Rhode
Island state police, and the
police officer’s local department. A local police officer’s power of
arrest obtained pursuant to this section shall be authorized
only for as long as he or she is under
the direct supervision of the superintendent of the state
police. The officer’s assignment shall be
for the duration of the statewide task force or unless
the superintendent of the state police
terminates the statewide task force prior to one year. The
superintendent of the state police shall
have the authority to reappoint a local police officer to
an additional one year term.
SECTION 2. This act shall take effect upon passage.
