A N A C T
RELATING TO
TOWNS AND CITIES - RETIREMENT OF MUNICIPAL EMPLOYEES

It is enacted by the
General Assembly as follows:
SECTION 1. Section 45-21-14.1 of the General Laws in Chapter
45-21 entitled
"Retirement of
Municipal Employees" is hereby repealed.
45-21-14.1. or town council service. --
Service as a member of any city or town
council in excess of six (6) months in any one year
constitutes one full retirement credit year;
provided, that any person who was elected to membership on a
city or town council at a special
election or was appointed to a city or town council to fill an
unexpired term, is entitled to receive
service credit for the full year during which that person was
elected or appointed if the person has
served as a member of the council during any part of the
year.
SECTION 2. Chapter 45-21 of the General Laws entitled
"Retirement of Municipal
Employees" is hereby
amended by adding thereto the following section:
45-21-8.1.
Exclusion of elected city or town council members. –
Notwithstanding any
provision of this chapter or any provision of the general or
public laws to the contrary, no city or
town council members elected for the first time after
November 6, 2012, shall be allowed
membership into the municipal employees' retirement system, as a
result of that elective service.
SECTION 3. This act shall take effect upon passage.
