A N A C T
VALIDATING
THE CONSOLIDATION OF THE WASHINGTON LIGHTING DISTRICT WITH THE CENTRAL COVENTRY
FIRE DISTRICT AND THE TRANSFER OF THE ASSETS AND UNPAID LIABILITIES OF THE WASHINGTON
LIGHTING DISTRICT TO THE CENTRAL COVENTRY FIRE DISTRICT, SECURING TO THE
CENTRAL COVENTRY FIRE DISTRICT, THE LIEN OF THE WASHINGTON LIGHTING DISTRICT
FOR UNPAID TAXES, AND THE SECURITY OF EXISTING LABOR CONTRACTS

It is enacted by the General Assembly as
follows:
SECTION 1. The
actions of the Washington Lighting District in consolidating with the
Central Coventry Fire District, in accordance
with the "Resolution for Consolidation" approved
by the district's qualified electors on March
28, 2006 is hereby ratified and affirmed.
SECTION 2. All
claims of the Washington Lighting District for unpaid taxes shall, no
later than sixty (60) days from the effective
date of this Act, become property of the Central
Coventry Fire District and the lien of the
Washington Lighting District upon property for the
nonpayment of taxes is hereby secured to the
Central Coventry Fire District. The Central
Coventry Fire District is hereby granted any and
all powers heretofore granted to the Washington
Lighting District for collection of unpaid
taxes.
SECTION 3. No
later than sixty (60) days from the effective date of this Act, the Tax
Collector of the Washington Lighting District
shall turn over to the Tax Collector of the Central
Coventry Fire District all tax lists in his/her
possession and all other records appertaining to the
office of said Tax Collector. No later than sixty
(60) days from the effective date of this Act, the
Tax Collector of the Washington Lighting
District shall transfer to the Tax Collector of the
Central Coventry Fire District all monies
collected by him/her in the course of his/her official
duties as Tax Collector.
SECTION 4. No
later than sixty (60) days from the effective date of this Act, the
Treasurer of the Washington Lighting District
shall turn over to the Treasurer of the Central
Coventry Fire District, all funds of the
Washington Lighting District. No later than sixty (60)
days from the effective date of this Act, the
Treasurer of the Washington Lighting District shall
turn over to the Treasurer of the Central
Coventry Fire District, all unpaid debts and liabilities of
the Washington Lighting District.
SECTION 5. No
later than sixty (60) days from the effective date of this Act, the officials
of the Washington Lighting District shall
transmit all books, papers, public records, minutes and
copies of labor contracts to the officials of
the Central Coventry Fire District.
SECTION 6. From
and after the effective date of this Act, the Washington Lighting
District shall be and is hereby terminated;
provided, however, that for the purposes of bringing
suit or other legal or equitable proceedings
against aid district and for no other purpose, the same
shall be deemed to be in existence for a period
of two (2) years.
For the purposes
of bringing suit or other action at law or in equity against said district,
any summons or subpoena shall be served upon the
Treasurer of the Central Coventry Fire
District. And the latter district shall be
required to satisfy any judgment entered in any such
action.
SECTION 7. The
consolidation of the Washington Lighting District with the Central
Coventry Fire District shall in no way terminate
or impair any existing labor contracts in effect
between the Washington Lighting District and its
employees.
SECTION 8. This
act shall take effect no later than thirty (30) days after the date of its
enactment and thereupon all inconsistent acts
herewith shall stand repealed.
