A N A C T

RELATING TO PROBATE PRACTICE AND PROCEDURE

It is enacted by the General Assembly as follows:

     SECTION 1. Section 33-13-1 of the General Laws in Chapter 33-13 entitled "Legacies,

Devises, and Inheritance" is hereby amended to read as follows:

33-13-1. Notice of devise or bequest to corporation or association. -- Within thirty

(30) ninety (90) days after the admission to probate of any will containing a devise or bequest to

any corporation or voluntary association, the clerk of the probate court before which the will is

proved shall deposit in the post office, postage paid executor or administrator or other estate

fiduciary shall mail by certified mail return receipt requested, a written notice of the devise or

bequest directed to the devisee or legatee at the place where it is located, if the same is known.

An affidavit of notice together with the return receipt shall be filed in the probate court.

     SECTION 2. This act shall take effect on September 1, 2006.
