A N A C T
AUTHORIZING
THE TOWN OF NARRAGANSETT TO ADOPT A TAX CLASSIFICATION PLAN

It is enacted by the General Assembly as
follows:
SECTION 1. Chapter
44-5 of the General Laws entitled "Levy and Assessment of Local
Taxes" is hereby amended by adding thereto
the following section:
44-5-11.14.
Commercial/residential real estate classification -- Narragansett. –
Notwithstanding any provisions of section
44-5-11.8 to the contrary, the town of Narragansett
may adopt a separate tax classification for
owner occupied mixed use combination commercial
and residential properties with five (5) units
or less provided that the total commercial portion of
the structure cannot occupy more than fifty
percent (50%) of the entire square foot size of the
structure itself. The tax assessor shall be
required to allocate the percentage share of the full and
fair market value of the property devoted to
residential real estate use. This portion of the
property shall be subject to the same tax rate
as property defined in class 1 by section 44-5-
11.8(b)(1)(i), while the remaining percentage of
the property shall be subject to the tax rate as
property defined as class 2 by section
44-5-11.8(b)(2).
SECTION 2. The
question of the approval of this act shall be submitted to the electors of
the town of Narragansett at an election on a
date to be determined by their town council which
occurs at least thirty (30) days after the
passage of this act. The question shall be submitted in
substantially the following form: "Shall an
act, passed at the 2005 session of the general
assembly, entitled 'An Act Authorizing the Town
of Narragansett to Adopt a Tax Classification
Plan' be approved?" and the warning for the
election shall contain the question to be submitted.
The town board of canvassers may combine any two
or more voting districts for the election and
when so combined shall be treated as a voting
district. If so combined, the town board of
canvassers shall advertise the combination of
districts in a newspaper of general circulation in the
town. From the time the election is warned and
until it is held, it shall be the duty of the town
clerk to keep a copy of the act available at his
or her office for public inspection, but the validity
of the election shall not be affected by this
requirement.
SECTION 3. This
act shall take effect after the approval by Narragansett electors at an
election held at least thirty (30) days after the passage of this act.
