RELATING
TO STATE AFFAIRS AND GOVERNMENT -- STATE POLICE

It
is enacted by the General Assembly as follows:
SECTION
1. Chapter 42-28 of the General Laws entitled "State Police" is
hereby
amended
by adding thereto the following section:
42-28-25.1.
Trainee compensation for death, disability, or injury. -- (a) All
trainees
of
the state police training academy shall be compensated for death, disability,
or injury incurred
while
in training under the provisions of this chapter as follows:
(1)
All medical expenses incurred as a result of such injury shall be paid by the
state; and
(2)
Death and disability payments shall be paid in accordance with section 42-28-21
and
section
45-19-1 relating to compensation for injuries causing disability or causing
death to full-
time
members of the state police in the course of performance of their duties.
(b)
In the computation of the benefits set forth in subsection 42-28-21(b), any
member of
the
state police training academy suffering an injury causing disability or death,
shall be
construed
to have been receiving the amount of salary to the lowest grade of full-time
members of
the
state police at the time of injury or death unless the disability as a result
of injury incurred in
the
state police training academy occurs subsequent to the trainee being sworn in
as a member of
the
state police, in which case the benefits shall be computed based upon the
highest rank attained
by
the individual at the time of disability.
SECTION
2. This act shall take effect upon passage and shall apply to all cases pending
on
the date of passage.
