A N A C T
RELATING
TO TAXATION -- THE RHODE ISLAND MILITARY FAMILY RELIEF FUND

It
is enacted by the General Assembly as follows:
SECTION
1. Chapter 30-3 of the General Laws entitled "National Guard" is
hereby
amended
by adding thereto the following section:
30-3-41.
The Rhode Island Military Family Relief Fund. – (a) There is hereby
created
the
"Rhode Island Military Family Relief Fund." The purpose of this fund
shall be to aid family
members
of the Rhode Island National Guard and military force reservists who have been
activated
or deployed for state or federal service.
(b)
In addition to funds deposited by the general treasurer in accordance with
section 44-
30-2.9,
the adjutant general is authorized to accept any grant, devise, bequest,
donation, gift,
services
in kind, assignment of money, bonds or other valuable securities, or moneys
appropriated
by
the general assembly for deposit in and credit of the fund.
(c)
The Rhode Island Military Family Relief Fund shall be administered by the
adjutant
general.
The adjutant general shall establish criteria pertaining to eligibility for
fund assistance.
The
funds will be distributed at the discretion of the adjutant general and in
accordance with the
established
criteria to the families of members of the National Guard or military force
reservists.
The
criteria shall be established in accordance with Chapter 35 of Title 42, the
Administrative
Procedures
Act.
SECTION
2. Chapter 44-30 of the General Laws entitled "Personal Income Tax"
is
hereby
amended by adding thereto the following section:
44-30-2.9.
Refund deduction for contribution to the Rhode Island Military Family
Relief
Fund. –
(a) There shall be provided as a tax deduction from any refund from the
Rhode
Island
personal income tax otherwise due to a taxpayer for a taxable year a
contribution to the
Rhode
Island Military Family Relief Fund. The provision for the contribution shall
appear on the
state
personal income tax return as follows:
Rhode
Island Military Family Relief Fund. Check is you wish to contribute [ ] $1, [ ]
$5,
[
] $10, or [ ] $ (write in amount of your tax refund for this program).
(b)
The tax administrator shall forward all contributions made to the Rhode Island
Military
Family Relief Fund to the general treasurer who shall deposit them into the
Rhode Island
Military
Family Relief Fund created under section 30-3-41.
SECTION
3. This act shall take effect upon passage.
