It is enacted
by the General Assembly as follows:
SECTION
1. Sections 40.1-3-3, 40.1-3-7 and 40.1-3-8 of the
General Laws in Chapter 40.1-3 entitled "Curative Services" are
hereby amended to read as follows:
40.1-3-3. Sanatorium known as Zambarano
Memorial Hospital.
Sanatorium known as Zambarano Memorial Unit. -- In tribute to the
memory of the late Dr. U. E. Zambarano, former superintendent of the state sanatorium,
counselor, administrator, and humanitarian, whose "friendly deportment
fostered a spirit of cooperation and unity," the state sanatorium at
Wallum Lake, Rhode Island, shall hereafter be known as the Doctor U. E.
Zambarano unit of the Eleanor Slater Rehabilitative Hospital.
40.1-3-7. Rules and regulations for
Zambarano hospital.
Rules and regulations for Eleanor Slater hospital. -- The
director of the department shall establish, in his or her discretion, rules for
the government of the hospital, regulations for the admission of patients, and
shall generally be vested with all the powers necessary for the proper carrying
on of the work entrusted to him or her.
40.1-3-8. Change of names of hospital for
mental diseases and state infirmary. -- The name of the state
institution at Cranston formerly known as the state asylum for the insane or
the state hospital for the insane or the state hospital for mental diseases,
shall hereafter be known as the "institute of mental health";
and the name of the state institution at Cranston formerly known as the state
almshouse or the state infirmary, or the general hospital, shall hereafter be
known as the "Eleanor Slater Rehabilitation Hospital";.
and together those institutions shall hereafter be known as the "state
of Rhode Island medical center". In any general law, other public law,
or resolution of the general assembly, and in any document, record, instrument,
or proceeding authorized by any such law or resolution, unless the context or
subject matter otherwise requires, the words "state asylum for the
insane" and the words "state hospital for the insane" or
"state hospital for mental disease" shall be construed to mean the "institute
of mental health within the state of Rhode Island medical center"; and the
words "state almshouse" or "state infirmary" shall be
construed to mean the "Eleanor Slater Rehabilitation Hospital"
within the state of Rhode Island medical center".
SECTION
2. Sections 40.1-3-8.1, 40.1-3-8.2, 40.1-3-8.3,
40.1-3-10, 40.1-3-11, 40.1-3-12 and 40.1-3-13 of the General Laws in Chapter
40.1-3 entitled "Curative Services" are hereby repealed.
40.1-3-8.1. Creation of advisory council --
Membership. -- There is hereby created a council to be
known as the "governor's advisory council to the state of Rhode Island
medical center." The council shall consist of nine (9) members all of whom
shall be appointed by the governor, who shall select at least one member from
each of the following: faculty of the university of Rhode Island; faculty of
Brown university; faculty of Providence college; Rhode Island medical society;
Rhode Island chapter of the American psychiatric association; Rhode Island
association for mental health; and the American geriatrics society. The
remaining two (2) persons shall be selected from the public-at-large with
consideration given to those persons who have indicated an interest in and
knowledge of improved care for patients at the state of Rhode Island medical
center, or individuals who have indicated an interest in and knowledge of the field
of mental illness and/or the field of geriatrics.
40.1-3-8.2. Appointment of advisory council
members -- Term of office -- Chairperson -- Secretarial services. --
(a) During the month of May, 1963, and during the month of May of each year
thereafter the governor shall appoint members of the council to succeed the
members whose terms will next expire, each such appointment to be for a term of
three (3) years and until their respective successors shall be appointed and
qualified.
(b) Any vacancy which may
occur in the council shall be filled for the remainder of the unexpired term in
the same manner as the original appointments.
(c) The governor shall
designate one member of the council as chairperson.
(d) The director of the
department of mental health, retardation, and hospitals shall provide the
council with secretarial services for the maintenance of records, recording of
minutes, mailing of notices, and any other necessary services.
40.1-3-8.3. Functions of advisory council. --
The council shall make recommendations to the superintendent of the medical
center and to the director of the department of mental health, retardation, and
hospitals on matters affecting patient care. It shall review the economic and
professional status of the personnel of the medical center for the purpose of
aiding the governor and the superintendent of the center in selecting and
maintaining the proper staff for the purposes of implementing the various
programs of the medical center; provided, however, that the advisory council
shall have no administrative power, but shall cooperate with and advise the
director of the department of mental health, retardation, and hospitals and
other department officials in the administration of the programs for care and
treatment at the state of Rhode Island medical center.
40.1-3-10. Staff and employees of hospital.
-- The director of mental health, retardation, and
hospitals shall appoint a medical superintendent of the Eleanor Slater
Rehabilitative Hospital who, under the direction of the director, shall have
the control and management of the institution. There shall be such other
employees as the director may deem necessary for the proper management of the
hospital, who shall be appointed by
the director, and he or she may discharge them or any of them at his or her
pleasure, subject to the provisions of chapter 4 of title 36.
40.1-3-11. Discharge, parole, or transfer of
residents. -- The director of mental health, retardation,
and hospitals may at any time parole or discharge any of the patients of the
Eleanor Slater Rehabilitation Hospital, and may in his or her discretion,
subject to the terms of commitment, permanently transfer the patient to any of
the institutions under his or her care and control for better care and keeping.
The director may parole any person confined in any state institution under the
control of the department of mental health, retardation, and hospitals, upon
such terms, conditions, and limitations as the director shall prescribe, during
the remainder of the term for which the person might be held in the institution
as specified, and the director may terminate such parole at any time and order
the return of the paroled person into actual custody. Any officer qualified to
serve criminal process in this state and any employee of the state department
of mental health, retardation, and hospitals is hereby authorized to serve any
such order and retake and return the person named therein to the institution
from which he or she was paroled.
40.1-3-12. Boarding out of hospital
patients. -- The director of mental health, retardation,
and hospitals may, if he or she deems it expedient, place any patient of the
general hospital within the state of Rhode Island medical center at board in a
suitable family in this state or elsewhere, such patient boarding in such
family to be under the supervision of the director or of such agent as he or
she may designate.
40.1-3-13. Cost of boarding out. --
The cost of boarding and maintaining an inmate placed in a private family or
elsewhere as provided in this chapter shall be paid by that person, if he or
she has any estate, or by the person liable for his or her support, if any such
there be, otherwise from the funds appropriated therefor; and the state
controller is hereby authorized and directed to draw his or her order or orders
upon the general treasurer for the payment of such sum or sums upon the receipt
by him or her of properly authenticated and approved vouchers.
SECTION
3. This act shall take effect upon passage.
