RELATING TO REDISTRICTING OF THE GENERAL ASSEMBLY

It is enacted
by the General Assembly as follows:
SECTION
1. Sections 22-1-1 and 22-1-2 of the General Laws in
Chapter 22-1 entitled "Composition of Senate" are hereby repealed.
22-1-1. Composition of senate. --
Commencing on the first Tuesday in January 1993, the senate shall consist of
the lieutenant governor and fifty (50) senators, one (1) senator being elected
from each of the senatorial districts into which the state is divided in
section 22-1-2.
22-1-2. Districts. --
The state is hereby divided into fifty (50) senatorial districts each of which
shall be comprised of the United States census tracts and blocks as hereinafter
set forth and each of which shall appear as depicted and bounded on the maps
compiled from United States Census Bureau information which are attached hereto
and which are hereby made a part of this chapter.
Thirty nine (39) of
such maps are denominated "TIGER * Plot, compiled by Election Data
Services, Inc." for each city and town, and hereinafter may be referred to
as TIGER map.
Six (6) of such maps,
are denominated "Final House Plan-E" or "Final House Plan"
for house districts, and five (5) of such maps are denominated "Final
Senate Plan-E" or "Final Senate Plan" for senate districts. One
map is for congressional districts.
The secretary of state
shall keep a copy of each set of the foregoing maps available for inspection
during ordinary business hours at his/her office. The secretary of state shall
furnish each city and town a copy of the TIGER map covering that particular
city or town within ten days of [May 22, 1992_.
For purposes of this
title, references to "tract" or "CT" shall mean
"census tract", as that demographic unit is established by the United
States Bureau of the Census for the 1990 census as described by maps and
publications of the bureau. References to "Block",
"Blocks", "Block Groups", "Enumeration District",
or "Enumeration Districts", refer to those demographic units as
established by the United States Census Bureau for the 1990 census as described
by maps and publications of the bureau.
Any reference to a
"city", "city boundaries", or "city limits" shall
refer to the boundaries or limits of the particular city as they existed on
January 1, 1990.
The first three (3)
digits of a census description refer to the county in which the district lies.
Bristol county carries the code 001; Kent county carries the code 003; Newport
county carries the code 005; Providence county carries the code 007 and
Washington county carries the code 009. The next four (4) digits refer to the
census tract within the city set forth in the description. The last three (3)
digits refer to the census block within the census tract. The letters
"MCD" preceding a municipality mean "minor civil division".
"TIGER" is an acronym for the computer readable geographic data base
that automates the mapping and related geographic activities required to support
the United States' Census Bureau's Census and survey programs and stands for
"Topologically Integrated Geographic Encoding and Referencing".
If any census tract,
block, block group, or enumeration district is omitted, listed more than once,
or is only partially provided for, it is intended that the districts be defined
in such a manner as to not omit any area of Rhode Island from a district and to
comply with the standard of Articles VII and VIII of the Rhode Island
Constitution requiring that districts be reasonably equal. In order to carry
out the intent of the general assembly as expressed in this section the
secretary of state, shall if necessary, undertake measures to insure compliance
with this section. For the purpose of this section, whenever a line is
described as running on, along, to or through any street (including road,
avenue, lane, way, parkway, expressway, divided highway, state route or
interstate route, or trail), stream or river, it is intended to mean the center
line of such street, stream or river, in all instances, unless the same shall
be otherwise specified.
In the event of a
discrepancy between the description of census tracts and blocks and the maps,
then the maps shall take precedence and be controlling.
22-1-2. Districts. --

SECTION
2. Chapter 22-1 of the General Laws entitled "Composition of Senate" is hereby
amended by adding thereto the following sections:
22-1-1. Composition of
senate. - Commencing
on the first Tuesday in January, 2003, the senate shall consist of thirty-eight
(38) senators, one (1) senator being elected from each of the senatorial
districts into which the state is herein below divided.
22-1-2. Districts. - The state is hereby divided into
thirty-eight (38) senatorial districts bounded and described as follows:
(1) it is
understood and intended that for the purpose of this section a line described
as running on, along, to or through any street (including road, avenue, lane,
way, parkway, expressway, divided highway, state route or interstate route, or
trail), stream or river, is intended to mean the center line of such street,
stream or river, in all instances, unless the same shall be otherwise
specified:
(2) It is
further understood and intended that for the purpose of this section, the
districts described herein shall be composed of United States census
geography (tracts and blocks), as defined by the 2000 version of the
"TIGER" files from the United States Census Bureau, whose boundaries correspond to the below
metes and bounds set forth herein and which are hereby made a part of this
chapter. A listing of which census blocks are contained within each district
shall be deemed to be incorporated by
reference.
(3) It is further understood and
intended that for the purpose of this section, the districts will be depicted
on thirty-nine (39) maps, compiled by Election Data Services, Inc. for
each city and town, and hereinafter may be referred to as town maps.
The secretary of state

to Paterson street; thence northerly on Paterson street to Angell street;
thence southwesterly on Angell street to Hope street; thence southerly on Hope
street to interstate route 195; thence westerly on interstate route 195 to
Point street; thence southwesterly on Point street to the Providence River;
thence northwesterly along the Providence River to interstate route 195; thence
westerly on interstate route 195 to Chestnut street; thence northwesterly on
Chestnut street to Pine street; thence northeasterly on Pine street to Richmond
street; thence northwesterly on Richmond street to Weybosset street; thence
northeasterly on Weybosset street to Union street; thence northwesterly on Union
street to Westminster street; thence northeasterly on Westminster street to

Second
district: The second senatorial
district shall consist of all of that part of the city of Providence bounded by
a line beginning at the intersection of Elmwood avenue and Princeton avenue;
thence easterly on Princeton avenue to Broad street; thence northwesterly on
Broad street to Comstock avenue; thence easterly on Comstock avenue to Prairie
avenue; thence northerly on Prairie avenue to Blackstone street; thence
easterly on Blackstone street to Plain street; thence northwesterly on Plain
street to Point street; thence northeasterly on Point street to the Providence
River; thence southerly along the Providence River to the Providence-Cranston
boundary line; thence southwesterly and northerly along the Providence-Cranston
boundary line to the former New York New Haven and Hartford Railroad
(hereinafter simply the "New York New Haven and Hartford Railroad"); thence
northerly along the New York New Haven and Hartford Railroad to Elmwood avenue;
thence northwesterly on Elmwood avenue to the point of origin.
Third
district: The third senatorial district
shall consist of all of that part of the city of Providence bounded by a line
beginning at the intersection of the Providence-Johnston boundary line and the
Woonasquatucket River; thence southeasterly along the Woonasquatucket River to
Glenbridge avenue; thence southwesterly on Glenbridge avenue to United States
route 6; thence southeasterly on United States route 6 to Rhode Island route
10; thence southerly on Rhode Island route 10 to Union avenue; thence
northeasterly on Union avenue to Messer street; thence southeasterly on Messer
street to Hanover street; thence continuing southeasterly on Hanover street to
Dexter street; thence southerly on Dexter street to Peace street; thence
easterly on Peace street to Elmwood avenue; thence southeasterly on Elmwood
avenue to New York New Haven and Hartford Railroad; thence southwesterly on New
York New Haven and Hartford Railroad to the Providence-Cranston boundary thence
northwesterly along the Providence-Cranston boundary line to the

Fourth district: The fourth senatorial district shall consist
of all of that part of the city of Providence bounded by a line beginning at
the intersection of the Providence-North Providence boundary line and Smith
street; thence southeasterly on Smith street to Chalkstone avenue; thence
easterly on Chalkstone avenue to Candace street; thence northerly on Candace
street to Douglas avenue; thence southeasterly on Douglas avenue to Fillmore
street; thence northeasterly on Fillmore street to Admiral street; thence southeasterly
on Admiral street to Charles street; thence continuing southeasterly on Charles
street to Stevens street; thence southeasterly on Stevens street to Hewes
street; thence northeasterly on Hewes street to North Main street; thence

Eighth
district: The eighth senatorial
district shall consist of all of that part of the city of Pawtucket bounded by
a line beginning at the intersection of Dickens street and the Rhode
Island-Massachusetts state boundary line; thence northeasterly and southerly
along the Rhode Island-Massachusetts state boundary line to the Pawtucket-East
Providence boundary line; thence westerly along the Pawtucket-East Providence
boundary line to New York New Haven and Hartford Railroad; thence northerly
along the New York New Haven and Hartford Railroad to Beverage Hill avenue;
thence southeasterly on Beverage Hill avenue to George Bennett highway; thence
northerly on George Bennett highway to Armistice boulevard; thence
southeasterly on Armistice boulevard to Mendon avenue; thence northerly on
Mendon avenue to Cottage street; thence southwesterly on Cottage street to
George Bennett highway; thence northwesterly on George Bennett highway to

avenue to Pawtucket avenue; thence continuing northwesterly on Pawtucket avenue
to New York New Haven and Hartford Railroad; thence northerly on New York New

Ninth
district: The ninth senatorial district
shall consist of all of the town of Barrington.
The ninth
senatorial district shall also consist of all of that part of the town of
Bristol bounded by a line beginning at the Bristol-Barrington boundary line in
the Warren River and the Bristol-Warren boundary line also in the Warren River;
thence easterly along the Bristol-Warren boundary line to Pawtucket avenue;
thence southerly on Pawtucket avenue to Loveland avenue; thence westerly on
Loveland avenue to Mount Pleasant avenue; thence southerly on Mount Pleasant
avenue to Butterworth avenue; thence easterly on Butterworth avenue to
Hawthorne avenue; thence southerly on Hawthorne avenue to San Miguel drive;
thence easterly on San Miguel drive to Normand street; thence southerly on

the Bristol-Warren boundary line; thence northeasterly and southerly along the
Bristol-Warren boundary line to the Bristol-Tiverton boundary line in Mount
Hope Bay; thence southwesterly along the Bristol-Tiverton boundary line to its
intersection with Clipper way; thence westerly on Clipper way to Viking drive;
thence northwesterly on Viking drive to Glenview drive; thence westerly on
Glenview drive to Ruth avenue; thence southerly on Ruth avenue to Hopeworth
avenue; thence westerly on Hopeworth avenue to Bray lane; thence northerly on
Bray lane to River street; thence westerly on River street to its intersection
with Violet court; thence northerly along the Violet court extension (boundary

northerly on Crandall road to Bulgarmarsh road; thence westerly on Bulgarmarsh
road to Main road; thence southerly on Main road to Seapowet avenue; thence
westerly on Seapowet avenue and its northerly extension (boundary line between
census blocks 440050417001010 and 440050417001004) to the Tiverton-Portsmouth
boundary line in the Sakonnet River; thence northerly along the
Tiverton-Portsmouth boundary line to the Tiverton-Bristol boundary line in
Mount Hope Bay; thence northeasterly along the Tiverton-Bristol boundary line
to the Tiverton-Warren boundary line in Mount Hope Bay; thence continuing

Eleventh
district: The eleventh senatorial
district shall consist of all of that part of the town of Bristol bounded by a
line beginning at the intersection of Bristol Harbor and State street; thence
easterly on State street to Thames street; thence northerly on Thames street to
Franklin street; thence easterly on Franklin street to Wood street; thence
northerly on Wood street to St Elizabeth street; thence easterly on St
Elizabeth street to Gray street; thence
northerly on Gray street to Roma street; thence easterly on Roma street to
Buttonwood avenue; thence northerly on Buttonwood avenue to Bayview avenue;
thence easterly on Bayview avenue to Metacom avenue; thence northerly on
Metacom avenue to Roosevelt drive; thence easterly on Roosevelt drive to its
intersection with the extension of Violet street; thence southerly on the
Violet street extension (boundary line between census blocks 440010309013000

The
eleventh senatorial district shall also consist of all of the town of
Portsmouth.
Twelfth
district: The twelfth senatorial
district shall consist of all of that part of the town of Middletown.
The
twelfth senatorial district shall also consist of all of that part of the town
of Tiverton not included in the tenth senatorial district.
The
twelfth senatorial district shall also consist of all of the town of Little
Compton.
The

The thirty-seventh senatorial district shall
consist of all of the town of South Kingstown.
The thirty-seventh
senatorial district shall also consist of all of the town of New Shoreham.
Thirty-eighth
district: The thirty-eighth senatorial
district shall consist of all of the town of Westerly.
The thirty-eighth senatorial district shall also consist of all of that part of the town of Charlestown not included in the thirty-fourth senatorial district.
SECTION 3.
Sections 22-2-1 and 22-2-2 of the General Laws in Chapter 22-2 entitled
"Composition of House of Representatives" are hereby repealed.
22-2-1. Composition of house of
representatives. -- Commencing on the first Tuesday in
January, 1993, the house of representatives shall consist of one hundred (100)
members, one (1) representative being elected from each of the representative
districts into which the state is divided in section 22-2-2.
22-2-2. Districts. --
The state is hereby divided into one hundred (100) representative districts
each of which shall be comprised of the United States census tracts and blocks
as hereinafter set forth and each of which shall appear as depicted and bounded
on the maps compiled from United States Census Bureau information which are
attached hereto and hereby made a part of this chapter.
Thirty nine (39) of
such maps are denominated "TIGER * Plot, compiled by Election Data
Services, Inc." for each city and town, and hereinafter may be referred to
as TIGER map.
Eleven (11) of such
maps, are denominated "Final House Plan-E" or "Final House
Plan" for house districts, and five (5) of such maps are denominated
"Final Senate Plan-E" or "Final Senate Plan" for senate
districts. One map is for congressional districts.
The secretary of state
shall keep a copy of each set of the foregoing maps available for inspection
during ordinary business hours at his or her office. The secretary of state
shall furnish each city and town a copy of the TIGER map covering that
particular city or town within ten (10) days of [May 22, 1992_.
For purposes of this
title, references to "tract" or "CT" shall mean
"census tract", as that demographic unit is established by the United
States Bureau of the Census for the 1990 census as described by maps and
publications of the bureau. References to "Block",
"Blocks", "Block Groups", "Enumeration District",
or "Enumeration Districts", refer to those demographic units as
established by the United States Census Bureau for the 1990 census as described
by maps and publications of the bureau.
Any reference to a
"city", "city boundaries", or "city limits" shall
refer to the boundaries or limits of the particular city as they existed on
January 1, 1990.
The first three (3)
digits of a census description shall refer to the county in which the district
lies. Bristol county carries the code 001; Kent county carries the code 003;
Newport county carries the code 005; Providence county carries the code 007 and
Washington county carries the code 009. The next four (4) digits refer to the
census tract within the city set forth in the description. The last three (3)
digits refer to the census block within the census tract. The letters
"MCD" preceding a municipality mean "minor civil division".
"TIGER" is an acronym for the computer readable geographic data base
that automates the mapping and related geographic activities required to support
the United States' Census Bureau's Census and survey programs and stands for
"Topologically Integrated Geographic and Encoding and Referencing".
If any census tract,
block, block group, or enumeration district is omitted, listed more than once,
or is only partially provided for, it is intended that the districts be defined
in such a manner as to not omit any area of Rhode Island from a district and to
comply with the standard of Articles VII and VIII of the Rhode Island
Constitution requiring that districts be reasonably equal. In order to carry
out the intent of the general assembly as expressed in this section the
secretary of state shall, if necessary, undertake measures to insure compliance
with this section. For the purpose of this section, whenever a line is
described as running on, along, to or through any street (including road,
avenue, lane, way, parkway, expressway, divided highway, state route or
interstate route, or trail), stream or river, it is intended to mean the center
line of such street, stream or river, in all instances, unless the same shall
be otherwise specified.
In the event of a
discrepancy between the description by census tracts and blocks and the maps,
then the maps shall take precedence and be controlling.

4. Chapter 22-2 of the General Laws entitled "Composition of House of
Representatives" is hereby amended by adding thereto the following
sections:
22-2-1. Composition of
house of representatives. - Commencing on the first Tuesday in January, 2003, the house of
representatives shall consist of seventy-five (75) members, one (1)
representative being elected from each of the representative districts into
which the state is herein below divided.
22-2-2. Districts. - The state is hereby divided
into seventy-five (75) representative districts bounded and described as
follows:
(1) it is
understood and intended that for the purpose of this section a line described
as running on, along, to or through any street (including road, avenue, lane,
way, parkway, expressway, divided highway, state route or interstate route, or
trail), stream or river, is intended to mean the centerline of such street,
stream or river, in all instances, unless the same shall be otherwise
specified:
(2) It is
further understood and intended that for the purpose of this section, the
districts described herein shall be composed of United States census
geography (tracts and blocks), as defined by the 2000 version of the
"TIGER" files from the United States Census Bureau, whose boundaries
correspond to the below metes and bounds set forth herein and hereby made a
part of this chapter. A listing of which census blocks are contained within
each district shall be deemed to be
incorporated by reference.
(3) It is further understood and intended that for the purpose
of this section, the districts will be depicted on thirty-nine (39) maps,
compiled by Election Data Services, Inc. for each city and town, and
hereinafter may be referred to as town maps.
The secretary of state shall keep a copy of each set of the
foregoing maps and a copy of the census tract and block listing available for
inspection during ordinary business hours at his/her office. The secretary of
state shall furnish each city and town a copy of the town map covering that
particular city or town within ten (10) days from the date of passage of this
act.
For purposes of this
title, references to "tract" or "CT" shall mean
"census tract", as that demographic unit is established by the United

The second congressional district shall also consist of all of that part of the city of Providence not included in the first congressional district.

6. Section 17-12-7 of the General Laws in Chapter
17-12 entitled "Party Committees and Conventions" is hereby repealed.
17-12-7. Composition of city and district
committees -- Appointment. -- The members of the several
ward committees in each city of the same political party shall constitute the
city committee of the political party for that city. For each of the political
parties, there shall be a senatorial district committee for each senatorial
district to consist of five (5) members where the senatorial district is
contained within a single city or town, and to consist of seven (7) members
where the senatorial district includes all or parts of two (2) or more cities
or towns. Senatorial district committee members shall in the first instance be
appointed by the chairperson of the state committee of the party. There shall
be a representative district committee for each representative district to
consist of three (3) members where the representative district contained within
a single city or town, and to consist of five (5) members where the representative
district includes all or parts of two (2) or more cities or towns.
Representative district committee members shall in the first instance be
appointed by the chairperson of the state committee of the party. The
senatorial and representative district committee members shall be qualified
electors of their respective districts and shall hold office respectively from
the date of their appointment and until the next election of the committees,
and thereafter until their successors have been elected, qualified, and
organized.

7. Chapter 17-12 of the General Laws entitled "Party
Committees and Conventions" is hereby amended by adding thereto the following
section:
17-12-7. 8. The senatorial committees of the senatorial
districts and the district committees of the representative districts in office
on the effective date of this act shall not thereafter exercise any powers of
nomination or endorsement of candidates for senator or representative, except
for an election for senator or representative prior to the first Tuesday after
the first Monday in November, 2002, but the chairperson of the state committee
of each political party, forthwith upon passage of this act shall appoint the
members of a senatorial district committee for each senatorial district and the
members of a representative district committee for each representative
district. Each of said senatorial district committees shall consist of five (5)
members except that in senatorial districts which include all or parts of two
(2) or more cities or towns, the committee shall consist of seven (7) members.
Each of said representative district committees shall consist of three (3)
members, except that in representative districts which include all or parts of
two (2) or more cities and towns, the committee shall consist of five (5)
members. Such district committee members, so appointed, shall hold office until
the primary elections in 2002 and thereafter until their successors shall have
been duly elected, qualified and organized. Nothing herein contained shall be
construed to vacate the office or terminate the term of office of any state
committee member of any party prior to the party primary election in September,
2002.
SECTION
9. Wherever in the general laws or in any public law
a duty is imposed upon the president of a town council or upon the local board
of any city or town or upon a town clerk, town sergeant or constable in
connection with the election of a senator or representative, such duty in the
case of a senatorial or representative district comprising parts or the whole
of more than one (1) town shall be deemed to be imposed upon the president of
the town council or local board or town clerk, town sergeant or constable of
each or all of the towns in which such senatorial or representative district
shall lie. Wherever in the general laws
or in any public law a duty is imposed
upon the city committee, town committee, or ward committee of a political party
in connection with the election of a senator or representative, such duty shall
be deemed to be imposed upon the senatorial or representative district
committee of the party as the context shall require.
SECTION
10. Wherever in the general laws or in any public law
reference is made to a senator or representative from any city or town, or to
the election of a senator or representative from any city or town, such
reference shall mean and be deemed to refer to a senator or representative from
a senatorial or representative district, or the election of a senator or
representative from a senatorial or representative district, as the context may
require.
SECTION
11. This act shall be liberally construed to
effectuate the purposes thereof and to apportion the state into senatorial or
representative districts in compliance with the requirements of the United
States Constitution. It is intended that the
senatorial or representative districts described herein completely
encompass all the area within the state and contain all the population residing
in the state. It is further intended that the apportionment and districting
provided for in this act results in the creation of districts containing
substantially equal population. It is also intended that no senatorial or
representative district shall include any of the area included within the
description of any other senatorial or representative district. If the districts
described in this act do not carry out the purposes thereof because of patent
unintentional omissions, duplications, overlapping area, erroneous
nomenclature, faulty description of boundary lines, street closings, changes in
names of streets or of public places, alteration of the courses of rivers or
streams, the filling in of lands under water or changes in shorelines due to
accretion, the secretary of state is hereby authorized and empowered to correct
such omissions, overlaps, erroneous nomenclature, or other defects in the
description of districts so as to accomplish the purposes and objectives of
this act. In making such corrections, the secretary of state shall be guided by
the following standards:
(1)
gaps in the description of any district shall be completed in a manner which
results in a total description of the district in manner consonant with the
description of adjacent districts;
(2)
areas included within the descriptions of more than one (1) district shall be
allocated to the district having the lowest population;
(3)
areas not included within the descriptions of any district shall be allocated
to the adjacent district having the lowest population.
SECTION
12. Sections 22-3-2 and 22-3-3 of the General Laws in
Chapter 22-3 entitled "Organization of General Assembly" are hereby
amended to read as follows:
22-3-2. Organization of senate -- Secretary
of the senate and reading clerk. -- At the time specified in
section 22-3-17, the senate shall be called to order by the lieutenant
governor, or, in the lieutenant governor's absence, by the secretary of state.
The roll of members as appears by the list of senators shall then be called by
the clerk, and the list shall be corrected by the secretary of state as
provided above. In the absence of the lieutenant governor, the senate shall
then proceed to elect one of their members to preside. If twenty-five (25)
nineteen (19) of the members whose names appear upon the lists are
present, but not otherwise, the senate shall then organize by electing a secretary
of the senate and a reading clerk, and shall immediately notify the house of
representatives that it is duly organized and ready to proceed with the
business of the session. The secretary and clerk shall be employees of the
legislative department under the jurisdiction and control of the senate, and
shall hold office for two (2) years, and until their successors are elected and
qualified.
22-3-3. Organization of house of
representatives -- Speaker -- Clerks. -- At the time specified in
section 22-3-17, the house of representatives shall be called to order by the
senior member in continuous service present from Newport, and if there are two
(2) or more members from Newport of equal seniority of service then by that one
of them that shall be senior in age, and if there is no member present from
Newport, by the senior member of the house in continuous service present, and,
if there are two (2) or more members of equal seniority of service, then by
that one of them who is senior in age. The roll of members as appears by the
list of representatives shall then be called by the reading clerk, as provided
above. If it appears that fifty-one (51) thirty-eight (38) of the
members whose names are upon the list are present, but not otherwise, the
member calling the house of representatives to order as provided above shall
call for nominations for the office of speaker, and shall receive the ballots
of the members whose names are on the list for that office, and after the
ballots have been counted by him or her and by the clerks of the house, he or
she shall declare the result, and the balloting shall continue until some
person receives a majority of all the
ballots, and the person receiving that majority shall be the speaker of the
house for the ensuing term of two (2) years. The member so calling the house to
order shall not receive, entertain, or put to vote any motion or question
whatever, or point of order, while acting as presiding officer, and any member
violating any of the foregoing provisions of this section, or allowing any
person whose name is not upon the list to participate in the organization of
the house or to cast any ballot for speaker, or who shall allow to be used in
the organization of the house any list of members not prepared and corrected as
provided in this chapter, shall be imprisoned not less than one year nor more
than three (3) years; and any clerk or other person who shall use this list in
the organization of the house, or who shall fraudulently alter, secrete, or
destroy any list of members, prepared or prepared and corrected, as provided
above, shall be punished by like imprisonment. Immediately upon the election of
a speaker, the house of representatives shall proceed to elect by ballot a
clerk of the house and a recording clerk, and upon the election of a speaker
and clerks as provided, the house of representatives shall be deemed to be
organized and shall immediately notify the senate that it is duly organized and
ready to proceed with the business of the session. The clerks shall hold office
for two (2) years, and until their successors are elected and qualified.
SECTION
13. This act shall take effect upon its passage;
provided, however, that the provisions hereof shall first be effective in
connection with elections to be held on or subsequent to the first day of
September, 2002, and for the purpose of greater clarity, the first election
under the provisions of this act for congress, senator and representative from
each of the senatorial, congressional or representative districts hereby
created, shall be held on the Tuesday next after the first Monday in November,
2002, and the first primary election under the provisions of this act for
nomination of candidates for congress, senator and for representative from each
of said representative district shall be held on the second Tuesday after the
first Monday in September, 2002, provided, however, that if any provision of
this act or the application of such provision to any person or under any
circumstances shall be held unconstitutional or otherwise invalid or
inoperative by a decision of any court of competent jurisdiction, or if any
action performed or to be performed under any provision of this act is
restrained or enjoined by any court of competent jurisdiction, the remaining
provisions of this act shall not be deemed to be impaired or affected thereby
but shall be deemed
to remain in full force and effect. Any primary or special election held prior
to the first day of September, 2002, shall be conducted under the laws as they
existed prior to the passage of this act.
