RELATING TO BUSINESSES AND PROFESSIONS -- BOARD OF MEDICAL LICENSURE

AND DISCIPLINE

It is enacted by the General Assembly as follows:

     SECTION 1. Section 5-37-8 of the General Laws in Chapter 5-37 entitled "Board of

Medical Licensure and Discipline" is hereby amended to read as follows:

     5-37-8. Grounds for discipline without hearing.

     The director may temporarily suspend the license of a physician or limited registrant

5

without a hearing if the director finds that evidence in his or her possession indicates that a

6

physician's or limited registrant's continuation in practice would constitute an immediate danger to

7

the public. In the event that the director temporarily suspends the license of a physician or limited

8

registrant without a hearing, a hearing by the board must be held within ten (10) days after the day

9

the suspension has occurred, excluding intervening days when the department is closed.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would provide that any day(s) when the department of health is closed be excluded

2

from the maximum number of days within which a hearing must be held by the board when a

3

physician or limited registrant's license is suspended without hearing.

4

     This act would take effect upon passage.
