RELATING TO HEALTH AND SAFETY -- EXPLOSIVES

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 23-28.28-37 of the General Laws in Chapter 23-28.28 entitled

"Explosives" is hereby amended to read as follows:

     23-28.28-37. Notice to adjoining landowners.

     (a) Prior to the commencement of blasting operations, any person, firm, corporation, or

5

other entity that is regulated pursuant to the provisions of this chapter shall notify any abutter and/or

6

the owner or owners of record of any improved real property, in writing, by registered mail, within

7

five hundred (500') feet, as measured from the nearest borehole to the closest improved real

8

property, of an intended blast or detonation, excluding road, bridge, utility, and public works

9

construction, no less than twenty-four (24) hours two (2) weeks prior to the blast or detonation.

Notice shall also be sent to the local police and fire department and town fire marshal, and the

11

building and zoning offices of the town where the property is located. Provided further, the state

12

fire marshal is authorized to establish rules and regulations necessary to carry out the provisions of

13

this section.

     (b) Exceptions to subsection (a) of this section shall be provided to any utility or public

15

works department acting in an emergency capacity that requires blasting operations and under such

16

conditions no less than twenty-four (24) hours' notice prior to a blast or detonation shall be required.

     SECTION 2. This act shall take effect upon passage.

     This act would require two weeks' notice to all abutters within five hundred feet of the

2

commencement of any blasting operations. Notice would also be sent to the local police and fire

3

department and city or town fire marshal, and the building and zoning offices of the town where

4

the property is located.

     This act would take effect upon passage.
