RELATING TO INSURANCE -- ACCIDENT AND SICKNESS INSURANCE POLICIES

     

     Introduced By: Senators DiMario, Kallman, Euer, Goldin, and Valverde

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 27-18 of the General Laws entitled "Accident and Sickness Insurance

2

Policies" is hereby amended by adding thereto the following section:

     27-18-85. Coverage for backup batteries for at-home medical devices.

4

     Every individual or group health insurance contract, plan, or policy contract delivered,

5

issued for delivery, or renewed in this state on or after January 1, 2022, shall provide coverage for

6

a backup battery for at-home medical devices. This backup battery shall be of equal or greater

7

quality than the original battery provided by the at-home medical device manufacturer or of equal

8

or greater quality than the battery the at-home medical device manufacturer recommends.

     SECTION 2. Chapter 27-19 of the General Laws entitled "Nonprofit Hospital Service

10

Corporations" is hereby amended by adding thereto the following section:

     27-19-77. Coverage for backup batteries for at-home medical devices.

     Every individual or group health insurance contract, plan, or policy contract delivered,

13

issued for delivery, or renewed in this state on or after January 1, 2022, shall provide coverage for

14

a backup battery for at-home medical devices. This backup battery shall be of equal or greater

15

quality than the original battery provided by the at-home medical device manufacturer or of equal

16

or greater quality than the battery the at-home medical device manufacturer recommends.

     SECTION 3. Chapter 27-20 of the General Laws entitled "Nonprofit Medical Service

18

Corporations" is hereby amended by adding thereto the following section:

     27-20-73. Coverage for backup batteries for at-home medical devices.

     Every individual or group health insurance contract, plan, or policy contract delivered,

issued for delivery, or renewed in this state on or after January 1, 2022, shall provide coverage for

3

a backup battery for at-home medical devices. This backup battery shall be of equal or greater

4

quality than the original battery provided by the at-home medical device manufacturer or of equal

5

or greater quality than the battery the at-home medical device manufacturer recommends.

     SECTION 4. Chapter 27-41 of the General Laws entitled "Health Maintenance

7

Organizations" is hereby amended by adding thereto the following section:

     27-41-90. Coverage for backup batteries for at-home medical devices.

     Every individual or group health insurance contract, plan, delivered, issued for delivery, or

10

renewed in this state on or after January 1, 2022, shall provide coverage for a backup battery for

11

at-home medical devices. This backup battery shall be of equal or greater quality than the original

12

battery provided by the at-home medical device manufacturer or of equal or greater quality than

13

the battery the at-home medical device manufacturer recommends.

14

     SECTION 5. This act shall take effect on January 1, 2022.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO INSURANCE -- ACCIDENT AND SICKNESS INSURANCE POLICIES

     This act would require health insurance contract plans or policies to provide coverage for

2

a backup battery for at-home medical devices, equal to or greater in quality than the original backup

3

battery provided by the device manufacturer.

4

     This act would take effect on January 1, 2022.
