RELATING TO MILITARY AFFAIRS AND DEFENSE -- RHODE ISLAND VETERANS'

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 30-24 of the General Laws entitled "Rhode Island Veterans' Home"

is hereby amended by adding thereto the following section:

     30-24-10.2. Reimbursement of overcharged residents.

     (a) Any present or past resident with service-connected disabilities of the facility who has

5

been overcharged during the term of their residency from January 1, 2007 to January 1, 2021, in

6

conjunction with maintenance fees in violation of 38 C.F.R 51.41 (c)(2), shall be entitled to full

7

reimbursement from the state of Rhode Island.

     (b) Reimbursement shall include the amount of the overcharge calculated from January 1,

9

2007 to January 1, 2021 to which interest in the amount of five percent (5%) shall be added to the

10

overall amount.

     (c) Any reimbursements that are unable to be conveyed to the estate of the deceased

12

resident or returned to any remaining next of kin shall be deposited into the Chaplain's Fund a

13

restricted receipt account created to improve the morale, welfare and recreation of the residents.

14

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would provide any present or past resident with service-connected disabilities

overcharged, during their residency from January 1, 2007 to January 1, 2021 in conjunction with

3

maintenance fees, to a full reimbursement with five percent (5%) interest. Any reimbursements

4

unable to be placed in the deceased resident's estate or returned to any remaining next of kin shall

5

be deposited into the Chaplain's Fund to be used for the benefit of the residents.

6

     This act would take effect upon passage.
