H O U S E   R E S O L U T I O N

CREATING A SPECIAL LEGISLATIVE COMMISSION TO STUDY AND PROVIDE

RECOMMENDATIONS ON THE ISSUES RELATING TO LATERAL ACCESS ALONG THE

RHODE ISLAND SHORELINE

     RESOLVED, That a special legislative commission be and the same is hereby created

2

consisting of twelve (12) members: two (2) of whom shall be members of the House who

3

represent a coastal community, not more than one from the same political party, to be appointed

4

by the Speaker of the House; one of whom shall be a resident of a coastal community, to be

5

appointed by the Speaker of the House; one of whom shall be the Executive Director of the

6

Coastal Resources Management Council, or designee; one of whom shall be a representative from

7

the Rhode Island Realtors Association or a home owner's association, to be appointed by the

8

Speaker of the House; one of whom shall be a representative from the Marine Affairs Institute &

9

R.I. Sea Grant Legal program at Roger Williams University, to be appointed by the Speaker of

10

the House; one of whom shall be from the Department of Marine Affairs at the University of

11

Rhode Island, to be appointed by the Speaker of the House; one of whom shall be the Executive

12

Director of either Clean Ocean Access or Save the Bay, or designee, to be appointed by the

13

Speaker of the House; one of whom shall be a land use attorney, to be appointed by the Speaker

14

of the House; one of whom shall be the President of the Rhode Island Society of Professional

15

Land Surveyors, or designee; one of whom shall be a retired Rhode Island Judge, to be appointed

16

by the Speaker of the House; and one of whom shall be a representative of the Rhode Island

17

Attorney General's Office with experience in shoreline access issues, to be appointed by the

18

Attorney General.

     In lieu of any appointment of a member of the legislature to a permanent advisory

commission, a legislative study commission, or any commission created by a General Assembly

2

resolution, the appointing authority may appoint a member of the general public to serve in lieu

3

of a legislator, provided that the majority leader or the minority leader of the political party which

4

is entitled to the appointment consents to the appointment of the member of the general public.

5

     The purpose of said commission shall be to make a comprehensive study and provide

6

recommendations on the issues relating to lateral access along the Rhode Island shoreline.

7

     Forthwith upon passage of this resolution, the members of the commission shall meet at

8

the call of the Speaker of the House and shall organize and select a chairperson from among the

9

legislators.

     Vacancies in said commission shall be filled in like manner as the original appointment.

11

     The membership of said commission shall receive no compensation for their services.

12

     All departments and agencies of the state shall furnish such advice and information,

13

documentary and otherwise, to said commission and its agents as is deemed necessary or

14

desirable by the commission to facilitate the purposes of this resolution.

15

     The Speaker of the House is hereby authorized and directed to provide suitable quarters

16

for said commission; and be it further

17

     RESOLVED, That the commission shall report its findings and recommendations to the

18

House of Representatives no later than March 30, 2022, and said commission shall expire on June

19

30, 2022.
