A N   A C T

RELATING TO PUBLIC PROPERTY AND WORKS -- STATE PURCHASES

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 37-2-45 of the General Laws in Chapter 37-2 entitled "State

Purchases" is hereby amended to read as follows:

     37-2-45. Supply disposition process.

     (a) The chief purchasing officer shall sell or otherwise dispose of all property of the state

5

which is not needed, or has become unsuitable for public use, or would be more suitably consistent

6

with the public interest for some other use, as determined by the chief purchasing officer. The

7

disposal of real property shall be subject to the approval of the state properties committee and

8

pursuant to the provisions of chapter 7 of this title. The determination of the chief purchasing officer

9

shall be set forth in an order and shall be reached only after review of a written request by the

10

agency desiring to dispose of the property. The request shall describe the property and state the

11

reasons why the agency believes disposal should be effected. All instruments, required by law to

12

be recorded, which convey any interest in any of the real property so disposed of shall be executed

13

and signed by the acquiring authority pursuant to the provisions of chapter 7 of this title.

     (b) Notwithstanding the provisions of subsection (a) of this section, the Community

15

College of Rhode Island, Rhode Island College, and the University of Rhode Island shall be allowed

16

to sell discarded or surplus technology including, but not limited to, desktop computers, laptops,

17

iPads and e-readers, to the students at those educational institutions at a discounted price to be

18

established by the state surplus property officer to offer affordable technology options to those

19

students. The monies collected shall be retained by the educational institutions and utilized by their

information technology department for the purpose of purchasing updated electronic equipment or

2

technology.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

RELATING TO PUBLIC PROPERTY AND WORKS -- STATE PURCHASES

     This act would authorize the Community College of Rhode Island (CCRI), Rhode Island

2

College (RIC), and the University of Rhode Island (URI) to sell discarded or surplus technology to

3

their students at a discounted price with the monies collected to be utilized to purchase updated

4

electronic equipment or technology for those educational institutions.

5

     This act would take effect upon passage.
