RELATING TO STATE AFFAIRS AND GOVERNMENT -- FORT ADAMS FOUNDATION

It is enacted by the General Assembly as follows:

     SECTION 1. Sections 42-57-1 and 42-57-3 of the General Laws in Chapter 42-57

2

entitled "Fort Adams Foundation" are hereby amended to read as follows:

     42-57-1. Foundation created.

4

     The Fort Adams foundation ("the foundation") is created a body, corporate and politic, to

5

promote interest in and to plan, develop, coordinate, encourage, facilitate, set standards, and

6

programs and projects relating to the restoration, renovation, reconstruction, and use of the

7

historical Fort Adams structure State Park.

     42-57-3. Organization of foundation.

9

     (a) The foundation shall consist of the director of the department of environmental

10

management, or his or her designee, a representative of the division of parks and recreation,

11

appointed by the director of the department of environmental management, and four (4) three (3)

12

public members, appointed by the governor with the advice and consent of the senate. In making

13

appointments under this section, the governor shall solicit and give due consideration to the

14

recommendations of the following persons, communities and organizations:

15

     (1) Rhode Island historical preservation commission;

16

     (2) City of Newport; and

17

     (3) Fort Adams Trust board of directors; and.

18

     (4) Chief of the department of environmental management division of parks and

19

recreation.

     In making appointments under this section, the governor shall also give due consideration

7

to the appointment of persons with expertise and experience in the fields of American history,

8

military history, historic preservation, museums, education, historic architecture and/or

9

engineering.

     (b) The director of the department of environmental management, or his or her designee

11

shall act as chairperson.

12

     (c) The power of the foundation shall vest in and be exercised by or under the authority

13

of its members, three (3) of whom shall constitute a quorum for the transaction of business.

14

     (d) Employees of the foundation shall be selected and appointed by the foundation, and

15

shall be vested with those powers and duties that the foundation may determine.

16

     (e) All appointed members of the foundation as of the effective date of this act shall cease

17

to be members of the foundation as of the effective date of this act. The governor shall thereupon

18

nominate four (4) three (3) members: one of whom shall serve an initial term of one year; one of

19

whom shall serve an initial term of two (2) years; and two (2) one of whom shall serve initial

20

terms of three (3) years. Thereafter, all appointed members shall be appointed to serve three (3)

21

year terms. In the event the senate is not in session on the effective date of this act, the governor

22

may make temporary appointments which shall only be in effect until such time as the senate

23

reconvenes at which time the governor shall appoint four (4) three (3) members.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

OF

RELATING TO STATE AFFAIRS AND GOVERNMENT -- FORT ADAMS FOUNDATION

     This act would allow the director of the department of environmental management to

2

appoint a representative of the division of parks and recreation as a member of the Fort Adams

3

Foundation and would expand the role of the Fort Adams Foundation to include the entirety of

4

Fort Adams State Park rather than the Fort itself.

5

     This act would take effect upon passage.
