A N   A C T

RELATING TO CRIMINAL PROCEDURE -- BAIL AND RECOGNIZANCE

     

     Introduced By: Representatives Knight, Craven, McEntee, Millea, and McKiernan

     Date Introduced: January 10, 2020

     Referred To: House Judiciary

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 12-13-6 of the General Laws in Chapter 12-13 entitled "Bail and

Recognizance" is hereby amended to read as follows:

     12-13-6. Bail or discharge for want of indictment or information.

4

     Every person who shall be imprisoned upon suspicion of having committed an offense

5

for which bail may be denied pursuant to the provisions of R.I. Const., Art. I, Sec. IX shall be

6

bailed or discharged if not indicted or charged by information within six (6) three (3) months after

7

the commitment.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

OF

RELATING TO CRIMINAL PROCEDURE -- BAIL AND RECOGNIZANCE

     This act would require that any person held in prison for a charge upon which bail may

2

be denied, shall be bailed or discharged if not indicted or charged by way of information within

3

three (3) months after commitment.

4

     This act would take effect upon passage.
