It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 42-20 of the General Laws entitled "Administration of State |
2 | Departments" is hereby amended by adding thereto the following section: |
3 | 42-20-17. Implementation of rules and regulations. |
4 | (a) Whenever, pursuant to law, any state agency is required to promulgate rules and |
5 | regulations, the state agency shall promulgate said rules and regulations by the first day of the |
6 | next legislative session. Rules and regulations not promulgated in a timely fashion, shall require a |
7 | written communication submitted to the clerks indicating the reason for the delay from the agency |
8 | responsible for the submission of their rules and regulations. |
9 | (b) Upon the promulgation of rules and regulations pursuant to this section, the director, |
10 | or designee, shall cause a copy of the rules and regulations to be delivered to the clerk of the |
11 | house oversight committee, and the clerk of the senate government oversight committee for |
12 | review. |
13 | SECTION 2. Chapter 42-35 of the General Laws entitled "Administrative Procedures" is |
14 | hereby amended by adding thereto the following section: |
15 | 42-35-2.13. Oversight committee records. |
16 | Any bill enacted into law that calls for the promulgation of rules and regulations, |
17 | necessary for the implementation of the provisions of the law by any agency of the state, shall |
18 | have a copy of the law transmitted to the house oversight committee and senate government |

1 | oversight committee, which shall keep a public record as to which state agency is responsible for |
2 | the promulgation of the rules and regulations, and the date of enactment into law. |
3 | SECTION 3. This act shall take effect upon passage. |

1 | This act would require state departments, when required by law, to timely promulgate |
2 | their rules and regulations, and would also require the house of representatives and senate |
3 | oversight committees to keep a public record of the rules and regulations adopted by each state |
4 | agency. This act would further require that the state agencies promulgate the rules and regulations |
5 | by the first day of the next legislative session. |
6 | This act would take effect upon passage. |
