A N   A C T

RELATING TO PUBLIC UTILITIES AND CARRIERS -- PUBLIC TRANSIT AUTHORITY

     Introduced By: Representatives Fogarty, Amore, Walsh, Hull, and Ajello

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 39-18 of the General Laws entitled "Rhode Island Public Transit

Authority" is hereby amended by adding thereto the following sections:

     39-18-25. Limitations of damages.

     In any tort action against the authority, its members and/or its employees acting in their

official capacity, any damages recovered therein shall not exceed the sum of one hundred

thousand dollars ($100,000).

     39-18-26. Damages in excess of limitation.

     The general assembly may, by special act, authorize actions of tort against the authority,

its members and/or its employees acting in their official capacity, in particular cases in which the

amount of damages to be recovered may exceed one hundred thousand dollars ($100,000).

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO PUBLIC UTILITIES AND CARRIERS -- PUBLIC TRANSIT AUTHORITY

     This act would limit damages to one hundred thousand dollars ($100,000) in any tort

action against the public transit authority, except in cases where the general assembly, by a

special act, authorizes a tort action in excess of that amount.

     This act would take effect upon passage.
