A N   A C T

RELATING TO EDUCATION -- FEDERAL AID

     It is enacted by the General Assembly as follows:

     1. Chapter 16-8 of the General Laws entitled "Federal Aid [See Title 16 Chapter 97 - The

Rhode Island Board of Education Act]" is hereby amended by adding thereto the following

3

section:

     16-8-16. Access to secondary schools and information on students by military

5

recruiters.

     (a) Each municipal or regional school department in this state that receives federal

7

assistance under the Elementary and Secondary Education Act of 1965: H.R. 2362, 89th Cong., 1st

8

Sess., Public Law 89-10. Reports, Bills, Debate and Act. [Washington]: [U.S. Govt. Print. Off.],

9

1965. Print. Referred to herein as"ESEA" shall:

     (1) Provide military recruiters with the same access to secondary school students as they

11

provide generally to postsecondary educational institutions and/or to prospective employers for

12

recruitment purposes.

     (2) Upon a request made by military recruiters for military recruiting purposes, provide

14

access to the names, addresses, and telephone listings of secondary school students.

15

     (b) A municipal or regional school department in this state may not release a student's

16

name, address, and telephone listing under subsection (a)(2) of this section without the prior

17

written consent of a parent of the student if the student, or a parent of the student, has submitted a

18

request that the student's information not be released pursuant to ยง 8528 of ESEA. Each

19

municipal or regional school department shall notify parents of the rights referenced in this

subsection.

     SECTION 2. This act shall take effect upon passage.
