RELATING TO BUSINESSES AND PROFESSIONS - PHARMACIES | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 5-19.1-3 of the General Laws in Chapter 5-19.1 entitled |
2 | "Pharmacies" is hereby amended to read as follows: |
3 | 5-19.1-3. State board of pharmacy -- Creation -- Membership -- Oath -- Vacancies. |
4 | (a) Within the department of health, there shall be a board of pharmacy, consisting of |
5 | nine (9) eleven (11) individuals, residents of the state of Rhode Island, one of whom shall be a |
6 | registered pharmacist who is currently employed in the department of pharmacy at a hospital |
7 | corporation in the state of Rhode Island during his or her term of appointment; two (2) of whom |
8 | shall be actively engaged in the practice of independent retail pharmacy; two (2) of whom shall |
9 | be representatives of the Rhode Island drug chain stores; two (2) of whom shall be actively |
10 | engaged in any field of pharmacy practice; two (2) of whom shall be pharmacy technicians |
11 | licensed pursuant to ยง 5-19.1-16; and two (2) of whom shall be from the public. All members, |
12 | except the public members and the pharmacy technician members, shall be registered pharmacists |
13 | and shall have been a licensed pharmacist for five (5) consecutive years in the state of Rhode |
14 | Island immediately prior to appointment. |
15 | (b) Members of the board shall hold office for a term of three (3) years. Appointment of |
16 | members shall occur as individual appointments expire, such that the composition of the board |
17 | will not be altered. All appointments shall be made by the director of health with the approval of |
18 | the governor. |
19 | (c) No person who has been appointed to and served for three (3) full consecutive three |

1 | (3) year terms shall be eligible for appointment to the board. |
2 | (d) Each member shall qualify by taking the usual oath of a state officer, which shall be |
3 | filed with the secretary of state, and each member shall hold office for the term of his or her |
4 | appointment and until his or her successor is appointed and qualified. |
5 | In the case of the resignation or disqualification of a member, or a vacancy occurring |
6 | from any cause, the director shall appoint a successor for the unexpired term. |
7 | SECTION 2. This act shall take effect upon passage. |
